KANSAS CITY, Mo. -- A 67-year-old grandmother who was shocked with a Taser stun gun after she honked her car horn at a police cruiser has been given a year's probation for sparking a quarrel with officers.
A charge of improper use of the horn against Louise Jones was dismissed last week in Kansas City Municipal Court. Her husband, Fred, 76, who became involved in the fray last year, also got one year of probation for the same charges -- resisting arrest and attempting to inflict injury on an officer.
The only condition of the probation is that the couple obey all laws.
The incident, which resulted in a change in department policy and the disciplining of two officers, happened in June 2004 as police were responding to a disturbance call across the street from the couple's home. Officers said they approached Louise Jones after she honked her horn, thinking she had reported the disturbance or perhaps was in trouble. A defense witness testified the honk was accidental.
"She immediately became hostile to us," Officer Ryan VanDeusen testified. He said that she continued the verbal assault when the officers returned to their squad car.
"It was very loud, it was antagonistic, it was very derogatory toward my partner and I," he testified.
Officer Cory LeMoine said he told Jones he could give her a ticket for honking the horn, and that a physical confrontation began after she wouldn't show him her driver's license. He said he and his partner struggled with Jones both inside and outside her house. The officers said that while VanDeusen was trying to handcuff her, Fred Jones came down the stairs and leveled his shoulder into him.
Teaching her a lesson?
VanDeusen said he used the Taser on Louise Jones when his partner couldn't get her under control.
The Jones disputed the officers' account. Louise Jones and other defense witnesses said she wasn't confrontational and that the comments she made were directed to a friend, not to the officers.
"She says something to the neighbor across the street and the officer didn't like that," said defense attorney Basil North. "He decided he was going to teach her a lesson."

I am totally shocked I mean really excuse her for hitting her horn which obviously sounds like an accident and not for the police but maybe her hand sliped or it was for someone else bloody hell I do think that the police could of handled it with out the fucking taser.Where are there heads at?What are you telling me that two officers couldn't handle a 67 and 76 year old with out resorting to violence.Sick Puppies. :mad:

That's true, but these days, who knows if ol' boy could have pulled a gun. The officers were disciplined but the ol' man got probation. Both sides kinda fucked up on this one!

She got hostile, resisted arrest, fought with the cops while being handcuffed. Her ol' man came down doing shoulder blocks. Don't put it across like the ol' lady was baking up a batch of cookies for the neighborhood kids and got tazered! :rolleyes:

they probably should have just blown both of their heads off right there. you shouldn't be a cop if you can't get a 67 year old woman under control without having to taser her like a cow or a pig.

The headline could read "Escaped Lunatic Tasered After Swinging Axe at Officer" and Pisshead would have a problem with it. After all, they shouldn't be a cop if they can't get an axe weiding psycho under control without a taser. That's just the Pisshead we all know and love. Shouldn't suprise anyone.
Bottom line is that no matter how it ended up the cops were going to get blamed for this one. What if they wresteled with the old woman and she broke her hip? What if they just popped her in the jaw? I agree that the police need to be restrained with their use of tasers but from what I have seen, in at least 95% of cases the "victim" could have prevented it by simply not resisting. It's like suing McD's because you got fat eating their food. people need to take responsibilty for their own stupidity instead of pointing the finger at others.

the cops had 3 options after the decision to arrest her had been made.
a) taser her with some pain for about 10 seconds, with usually NO lasting effects.
b) wrestle with a fragile old lady and likely hurt her, being sued for millions.
c) shoot her in the head... many many lasting injuries.
Take your pick.

I just wanted to point out the one line everyone keeps ignoring when supporting their point.....

.....Note the key line.....the cops are apparently in the wrong, but hey cops have lied before about beating a man half to death havent they ;). But nawwww it must be the crabby old lady because we all know how dangerous they are....
p.s. Yocass what do you think is going to happen to the old lady if they taser her she's magically going to stay standing up? She's less likely to get hurt being held then being shocked unconscious and crashing to the pavement......Either way she can sue....

Resisting wrongful arrest is still resisting arrest so quite possibly that. However I missed nothing as I was only pointing out some people were ignoring the key point the defense has "other" witnesses.....(the sad aspect of life is police officers are granted special credibility simply because of their profession when in retrospect its actually a rather inane practice and completely prejudicial)
Reciting the entire thing would have been pointless.....I didnt say at anytime or even infer the old folks did absolutely nothing wrong (but now come to think of it resisting a wrongful arrest in my honest opinion is completely within someones rights....well if they don't live in a dictator led country of course ;) ) But hey if you gotta jump on anything you can possibly infer negatively to your opinion you go right ahead ;) maybe I'll even get one of your patented "bwa's" if im lucky :)

I still think they should have continued to talk to them until the situation calmed down. Being shocked like that at her age could cause a heart attack and kill her.

Yeah exactly that would be the correct way of handling the situation but I guess that just to much to ask for, instead they handle it the best way they know how ...with violence,typical! I was just thinking about that as well I mean you know she could of had an heart attack or stroke I mean seriously who is to say that she did resist arrest and it's not the cops trying to justify there actions?

I??d guess that the woman and her husband probably did antagonize the cops, who came to investigate something (possibly dangerous) and were met with verbal abuse and physical hostility by this couple. Cops are human beings, and all people have their limits. If anybody does not understand this, and throws more fuel on a fire, then they can't expect to walk away unscathed every time they get nasty with law enforcement officers who, by the way, are putting their lives on the line every day for the public.
All she had to say was something like, ??Everything??s OK here, officer, I hit the horn by mistake. Sorry!?. I think that would probably have prevented the problem from escalating.
