Hey i just got back from court and i won. At first i said guilty. Then the judge asked what happened and i told him how i wasnt doing anything wrong and the cop searched me and my wallet even though i said "i dont consent to a search". And since the cop wasnt there to defend himself the judge dismissed the case and i didnt even pay a fine! :)

dont police have the right if there is probable cause or something and dont need consent? and you plead guilty but the judge decided to not punish you? and it was for posession, even though just a gram? well, a very "unique" story and i hope if i ever get busted for anything i am in the city and state you are..

Yeah great news for ya, but I can't believe they bothered with 1 gram. If they did that in the UK there'd be even more wasted cop time than there is now

in texas, if it is small like that, they will take and weigh everything with it..the roach, the whole ashtray if it has a roach in it, they will even weigh the whole bong..anything with residue on it is considered part of the total weight..i have very personally seen 1 joint turn into a 13 gram offense..

I don't know all the specifics, because they vary from one jurisdiction to another, and I am not in possession of all the facts in this case. The officer very well may have had probable cause, but since the officer failed to appear and provide his reasoning for the search, the judge had no choice but to dismiss the case. A fortuitous break for the OP - it very well could have gone differently had the officer appeared in court.

While police may seize small quantities for personal use from time to time, once charges have been filed, the contraband must be taken into evidence, weighed, tagged and filed. Once this happens, it's out of reach, as far as anyone is concerned. After the charges have been addressed in court, the material will be destroyed. No cop is going to risk stealing it out of evidence, since the risk of getting caught and prosecuted is too great - and you know what happens to cops in prison. OTOH, if no charges were filed, but material was seized, there's a good chance he might take it for himself. Perks of the job, I suppose.

^^^^Good point, Beeble, but what he's saying is that the cop prolly seized like 10 grams of dank from this kid, and took 3 for himself and turned in 7 grams as the "evidence".

I had a sherrif pull me & buddy over.exp tags & california stop,found some good green & pipe,made me toss pipe.Then the bastard put the green bud(was mix with dirt weed that he knocked off thg green) in his shirt pocket told us to get the car registerd!

This is why I'm glad I live in NJ, about 1/2 mile from NYC... a friend of mine's been caught 3 times, and the harshest penalty he's gotten was a $75 fine.

If i go downtown kinda to where i use to chill with my friend, we'd smoke a lot down there.(i guess you could say it was the ghetto but not exactly) But the cops around there if they drove by and you even looked at them, they would pull over and search you. Luckly never happened to me but i knew a few people it happened to. Man being down there was so fucking scary at night like i remeber we had to walk to this one house to go get some weed, and the apartments right next to it, were watched by cops a lot. It was so weird cuz we get to the house and we go all the way around to the back of it and he knocks on the door, some dude like half asleep answers the door and then my friend is like "hey can we get a dub?" so like half asleep the dude walks over to that apartment area, gets the dub and then comes back. And we leave. Man i remeber the whole time just being super paranoid and just wishing we'd get back to my other friends house.

Actually, the test for probable cause is the same in all jurisdictions. Search and seizure laws are based on the United States Constitution, thus they are applicable in all states and territories governed by this document. It is pretty complicated stuff when dealing with reasonable suspicion and probable cause, and the law is constantly in flux. As Beeble stated though, you have to take it on a case by case basis, but for a cop to search your wallet he would almost always need consent, a warrant, or to have placed you under arrest first. Sounds like he screwed this one up. (You gotta love it when the pigs fuck up) It is always nice to hear that the good guys have won for once, so smoke a bowl to celebrate.

the cop was probably too embarrased to show up because he knew the Judge would have grilled him..

Your lucky the prosecuter (sp?) didn't ask for a continuance. Thats what happens around here if a cop doesn't show up. They can even do it a couple times if the cop doesn't show up.

What a joke. I wish I could be like "Sorry I didn't make it into court I slept late" and then they say "Ok np I understand we'll just make a new date for about 4 months in the future!!"

Thats pretty much what they do. You can also ask for a continuance yourself. I do it for traffic violations all the time. I tell them i havn't found a lawyer yet and i need a continuance. You can file a continuance twice before you go from county court to mayors court and you can keep working your way up. I think theres some statuate of limitations (or some bullshit) that says the court has 180 days to prosecute for traffic violations. I have once succeeded in filing enough continuances that there time ran up and i was not able to be prosecuted. Just a fucking speeding ticket. 112mph in a 65. the cop was there EVERY single court date. hahaha. OWNED.

i love hearing happy endings for court cases....to bad for the cop though .. he was probably busy sucking a dick or kicking a dog or some other type of narc related type of activity
