A Texas couple is fighting to regain custody of their 12-year-old cancer-stricken daughter after the state seized the girl, claiming her parents have not done enough to treat her.

A judge has postponed until tomorrow a ruling on whether or not doctors can treat Katie Wernecke against her parents' wishes, KPRC-TV in Houston reported.


Katie's parents, Michele and Edward Wernecke of Agua Dulce, Texas, say their daughter's Hodgkin's disease is in remission and she doesn't need radiation treatment after undergoing a round of chemotherapy. Mr. Wernecke is worried that more treatment will have harmful long-term effects on his daughter and wants an opinion from doctors outside Driscoll Children's Hospital in Corpus Christi.

But the Texas Child Protective Services believe the recommendations of doctors at the hospital should overrule the parents. Robert Rosetti, program director over investigations at the CPS Nueces County office, claims the parents are being "medically neglectful."

Speaking this morning on NBC's "Today" show, Michele Wernecke said her daughter's illness is unique and should be treated as such.

"I think they should treat her for what her body calls for and not standard protocol. Nobody will look at that," she said. "Not every cancer is the same. Nobody understands that. Her body is not standard, and her cancer is not standard."

The Werneckes, members of the Church of God, have said they oppose blood transfusions unless they are from Katie's mother, but she is not a match, according to doctors.

Their attorney, Daniel Horne, however, said religion isn't at issue. He says his clients don't believe doctors haven't been upfront about Katie's care and have not answered all their questions about radiation's side effects.

"This issue is about parental rights, not about religious rights," Horne said. "They just want to be informed of her treatment. They want to be involved in this."

Last week, the state issued an Amber Alert that led to the seizure of Katie, who is undergoing tests at the University of Texas M.D. Anderson Cancer Center in Houston. The couple's three sons were also taken and are in a foster home.

Michele Wernecke was arrested on charges of interfering with child custody and was released Monday after posting $50,000 bond.

According to KPRC-TV, juvenile court Judge Carl Lewis said in a hearing yesterday he would wait until Friday to make a decision on the radiation treatment after receiving more information from doctors.


Katie, who was diagnosed with cancer in January, does not want the treatment.

"I don't need radiation treatment. And nobody asked me what I wanted. It's my body," she said in a videotaped message to her parents.

The family maintains a blog entitled Pray for Katie on which her parents claim she is being used in a research project.

States the blog: "Why are the doctors doing this? Katie appears to be part of a study where they allocate kids randomly to one treatment, say standard chemo plus radiation, and chemo only in the other treatment. Parents are not informed of this. They are doing research on our kids. Collecting research money from the drug companies, I guess."

A custody court hearing is set for June 15.

and this is just one case of thousands and thousands and thousands and thousands nationwide.

there are handbooks in the schools that teach future CPS workers about how to break up families, and how the family is evil and dangerous...literally, in the Calhoun readers...it actually describes how the family is bad and must be broken up.

all a part of the new freedom.

then again, there are thousands of kids in state custody in TX alone, and most of them on are of upwards of 4 psychotropic drugs...

it's all a part of the new freedom. soon we'll all be tested for our psychological disorders...if we disagree with the government, we may need to be forcibly drugged.

Wernecke family goes to court, mother speaks to media

CORPUS CHRISTI - Wednesday afternoon, the Werneckes went to court. They're seeking an injunction to prevent Child Protective Services from forcing Katie to undergo radiation therapy.

They appeared before Judge Carl Lewis arguing that Katie's cancer is now in remission and they don't believe the treatment is necessary at this point. But CPS argued otherwise saying it believes that Katie's survival could be jeopardized if the treatment is postponed. The judge will not make a decision until Friday when Katie undergoes a pet-scan to determine if she still has cancerous cells in her lymph system.

Judge Lewis also ruled that three of Katie's brothers who were removed from their Agua Dulce home may now return as long as CPS caseworkers believe the home is fit to live in.

In the meantime, Katie remains in foster care. Also Wednesday we heard from Mrs. Wernecke for the first time. She said it's something she wanted to do it's something Katie wanted to do. Of course, it led to only our county's second-ever Amber Alert and Mrs. Wernecke going off to jail.

This is a debate where the Wernecke's said they don't want just what the doctor ordered. When Katie Wernecke and her mother Michele went out in hiding at their Freer ranch they recorded a videotape to get Katie's message out.

"So Katie would be able to be heard. She wasn't being heard. Nobody would listen to what Katie had to say," said Michele. The message is loud and clear.

"I feel great. I don't need radiation treatment. And nobody asked me what I wanted. It's my body," said Katie on the videotape. The message is echoed by her parents.

"That cancer has died. They didn't expect it and it's dead," said Edward Wernecke. "So why are we asking to injure Katie anymore with radiation treatments?" Michele said with Katie's health improving the risk of radiation treatment is too much for her body to endure. They knew they were breaking the law by running away.

"Scared, but I know I was doing the right thing to protect my daughter," said Michele Wernecke. Katie keeps a good spirit on tape, but with doctors at Driscoll Children's Hospital saying one thing and Katie and her parents saying another it's been tough for this girl who turns 13 on Saturday.

"She talked about going into depression, quit eating and I tried telling her that she's got to be brave, eat, keep her strength up. I don't want her sick again," Michele said. She said if Katie had her way...she'd still be hiding out.

"When they picked us up, she started crying."

CPS meantime, says it has reports from several doctors that essentially the clock is ticking and Katie's cancer could spread without additional treatment. The state's position remains the same.

"We've seen a lot of different reports, and we really acted on this in an emergency situation. So we want to get her treatment as soon as possible," said CPS spokesperson Scott Dixon. The court battle is not over yet. The judge will hold another hearing on Friday and next Wednesday.

It's a sick fucking world, pisshead. it seems like typical propaganda. Take a real human interest story like kidnapped kids and sell it to america. Nobody with a heart would even think to refute the amber alert. It starts off all nice but with frequent integration of the doctrine i.e. having people nationwide looking for people to report back to government. Watch. Tomorrow it will be amber alerts for terrorists and then drunk drivers and then litterbugs and then anyone who disagrees with tyrannical rule.

I think that C.P.S. has too much power, just like this damn government.
I've read about kids being taken away from their parents, just because of their religious beliefs. Wiccans, and any other peoples who practice different paths of Paganism have had this happen to them. This is a fucking outcry!, but who would listen? It's sad to see that the publick is conditioned and trained to let the leaders, and law inforcement agencies do apsolutely anything they please. The cps. is supposed to get all of these abused children, not destroy families. I'd love to see those that love their government jump on this thread.

i was listening to a neocon talk show the other day (lars larson i think) where this was the topic...95% of callers i heard were outraged and disagreed with this...they were sickened and disgused that CPS took these kids away...

not only did they take away the girl with cancer, they took their other 2 kids away too!! absolutely outrageous.

unfortunately, nothing will be done until the threshhold is reached where enough people have been fucked over by some form of government and they realize how bad things are across the board.
