Yup...and there is no cause or suspicion....no return to work issues. They found a joint in the parking lot and are testing EVERYBODY. Calling it random....but using direct observation. My state really doesn't have any laws regarding testing...so I guess employers can get away with what they want??? I am going to have to refuse on principal alone.... I am not a criminal...I will not strip and have some chick staring at my stuff while I pee in a cup....that is just degrading. So I guess I will be losing my job :(

I would feel differently had I fucked up an initial test....or been stupid enough to be under the influence at work and raise suspicion....still don't think I could pee in a cup in front of anyone....but I would feel different about them.

I feel they are violating my right to privacy. Right now I am more angry than freaked out.

I am sorry to hear about this. Obvious B.S. The irony and the hypocrisy of stories like this are that there's probably no shortage of your fellow employees, management and workers alike, who engaged in a little mood-alteration the night before....with alcohol. My guess is that, ultimately, you were more stone cold sober at your workplace than many of them. I feel your frustration and anger. In my profession, the government has decreed that a certain percentage of the workforce is to be randomly tested. I always find it sickening that the very people who pass these laws will not pass the same laws for themselves. After all, don't we, as the citizens, deserve to know that our legislators are stone-cold-sober when they make crucial decisions? ....But of course, that'll never happen.

Anyway, I remember the same thing happening when I was in the military. One guy returned from a holiday in Thailand and tested positive. Next thing, everybody is getting tested....direct observation. That sucks. I'm sorry to hear about it. Best wishes to you.

I was under the impression that direct observed tests can only be performed under a limited number of cases per SAMSHA federal regulation. Maybe I'm mistaken on that and BT's encyclopedic knowledge can clear that up.

Well....I made it through that round and am prepared if it comes up again...this is all so messed up on so many levels...But I can't put it out here for fear of too much info...but if all the planets are aligned I still have a chance to pass it should my "#" come up before I am clean. OMG! 4 weeks is going to seem like forever....hoping they get behind again. But I was told it is not direct observation...the person in the bathroom with you turns their head/back. REALLY??? We aren't talking about a bathroom with stalls...they are standing 2ft or less from you. Back turned or not...still unacceptable.
