Is my medicine deductabile --can I claim it?--Has anyone tried??

Your medicine is considered an over-the-counter medicine and is subject to NM sales tax. As such, it is NOT deductible on your Schedule A - Itemized deductions. If you prepare your own return, you can try and include the amount spent on your Scheedule A and hope you don't get audited.

I had the same Q last year, from what I found, you should be able to, but on the federal side, you might as well be sending them a letter saying come get me. IN MY OPINION, NOT WORTH THE RISK UNTIL OBAMA TAKES A FAVORABLE SIDE ON MMJ
