Got a dilemma. Both husband and I have OMMP cards and grow in our home. He is going to plead not guilty, but eventually he will be found guilty. He will not be allowed to medicate while on probation, and will most likely loose his card. While he's on probation, will I not be able to grow in our home either?

That all depends on your local state laws but I doubt u will be able to unless u want your husband to get violated by his probation officer. Even though they are not his plants he becomes liable because he lives in that home as well and the law really doesn't care bout that. So chances are he would get in trouble. I'm in California and I noe that over here that's a big no no. Hope that eases ur mind a lil

Hum... Well this really sucks, don't it. :( I was thinking maybe if the room is locked, but it isn't worth the risk should his future PO find out about it. Be both just renewed our cards too, and to move my grow location would cost another $100.

Respectfully I dont DUI ! For you ! Not for me... I have a seat belt ! And an air bag to deflect your ass coming out of your head towards me ! ;)

Now you have to get a cab to the depository !

I didn't get the DUI, my husband did. I've been telling the dumb ass to stop myself, but now he screwed himself out of $400 for this years card. I still have my card, and I don't drink and drive!!!

But as the say, don't do the crime if you can't do the time", or punishment in his case... hmmm, and yours... I wish I could advise regarding the original question...

Maybe yo should ring around to the dispensaries ? They might have seen this stuff before... Does this mean your stash is cut in half ? Time for a vaporiser to save weed !

Contact your husbands defense attorney and ask him what the law is about in your state. This is not a felony so there should be no restrictions on what you yourself do in your own home. It will mean he can't smoke until he's done with probation. And yes he could try and play the system and still smoke but its just not worth the risk. He screwed up and if he screws up on a drug test he will be incarcerated. While smoking is nice its not worth being incarcerated over it.

I agree, Killer. not worth it, and he has a list of questions to ask his attorney week after next. The earliest we will have to worry about it is Mid July. Should be able to finish at least one more grow in that time. It's just going to be a pain to move everything if you can relate!

Because he's not charged with a felony that should not effect your ability to grow for yourself. It just means he will not be able to use cannabis till probation is over.

I agree with killer have some questions urself to ask the attorney relating your rights. Personally I have gotten close with your situation just make sure on his probation rights that you won't have a "surprise visit by the PO officer "

i had a friend here in michigan that flat came out and told the judge and his probation officer that he has his card for MEDICAL REASONS and he was allowed to use it still just like if he had prescriptions. they cant take away ur prescriptions. ide talk with his attorney and have it brought up, cuz my buddie is now allowed to drop dirty for that, just has to pass breath tests and do a.a. classes....its kinda 1 of those gray areas

Yeah a lot depends on which state you live in and how knowledgable and unbiased the judge will be in the case. But its certainly an arguement you should bring up with the attorney. He will have intimate knowledge about the judge you will be dealing with. If he's a liberal judge you might get a break.

We're in a small town in Oregon, and know the judge is a hard ass towards DUII, but I don't know about MM. His wife was killed by a drunk driver years ago, so I've heard. I don't know who his PO will be yet, but I guess we will find out. He will be staying with a friend who lives 5 minutes from his work, when his suspension begins. The question for the judge I guess is what is more acceptable, use of MM for his pain, or the use of Oxicodone for his pain that does become addicting, and does require more and more for relief from pain.

He is being evaluated for early onset Alzheimer's Disease also. He's been having symptoms of short term memory loss, poor judgement (as seen by his duii) and repeating things, or asking the same questions over and over, and the agitation from too much stimulation. His mother, 2 uncles and his grandfather all had early onset Alzheimer's disease. Hubby will be 60 late this year. Yes, my life sucks, not to mention my own pain level from disease.

I honestly don't think u and your husband will have a problem especially from wut I here about mm in Oregon just try and fight the argument. Best of luck with your situation

If you lose in court then find a family and trusted friend, that can get a OMMP, or rent you space. If I recall in Oregon ( I am in Oregon) you can grow even in rented space. So if a pal wants to rent you space they could rent it or become a grower for you and solve it that way. Just make sure its all nice and legal and that would be a way out to still grow.
