The advisory board of the Health Department sent in a draft of rules that included altering the definition of a primary care-giver as one that is allowed to charge ones patients for services related to the Medical Marijuana they were providing such as instruction in it's proper use and which strains would suit a patients condition best.

The Attorney General rejected the draft, citing garbage about constitutionality, meanwhile they are blindly signing anything that crosses their desk that strips patients of their rights. Lets be sure to get rid of these guys when it comes election time. The following is from the Colorado Dept. of Health's website:

The Colorado Department of Public Health and Environment (department) is posting its draft rules regarding primary care-givers in the medical marijuana program registry (MMR) for additional public comment. pdf logo The department previously posted these draft rules and heard testimony before the Medical Marijuana Advisory Committee (MMAC) concerning the content. The rules approved by the MMAC and recommended to the Executive Director for promulgation by the Board of Health have been reviewed by the Office of the Attorney General and determined to be out of compliance with C.R.S. ยง 25-1.5-106(3)(b)(I) and the Colorado Court of Appeals opinion in the matter of People v. Clendenin, 232 P.3d 210 (Colo. App. 2009).
