MMJ Patient Cooperatives Legal?

Hi 'Yall,

It's been a bit since I've posted-busy in the gardens. I've not been able to locate much, if any, on the State stance on Patient Cooperatives.

I'd like to gather some patients, not caregivers, not businesses, just patients, to bind together in a single large grow.

We would all put in time in tasks fitting our skill level and share the bounty.

Does any one know if there is an official position on this? Could we rent a separate area for the coop without applications? Could we make it a nonprofit?

I doubt it's legal, but I like the idea of non-commercial growing. Another option is for six patients to get together, select one of their own as caregiver and then do a communal grow. One person would be a caregiver on paper, (likely the person who hosts the grow) but the grow would be non-commercial and the patients would own the plants and share the costs, labor and the harvest.

HB10-1284 only mentions that caregivers can not grow collectively. So at least that part is not defined as illegal.

The problem might kick in if one patient was working on another patient's plants. Does that act make them a caregiver for the patient's plant that they are "caring" for?

Consult an attorney for a legal opinion. The ramifications of an ill advised collective are severe.

I like the idea though.
