can you be a little more specific? they won't file a search warrant for small possession. if they are at your house all they have to do is say the smell MJ and they have probable cause. if you are growing and worried about that, well that all depends. they could technically get a search warrant at moments notice (all they have to do is call and wake up a judge in the middle of the night), but they won't waste their time unless they can get a conviction so they will spend time building up a case, gaining evidence etc.

Depending on the case, an officer can call a judge and obtain a warrant over the phone. They usually don't bother a judge unless there are extenuating circumstances such as fear of flight or destruction of evidence. You don't hear of it happening too much over drug cases unless you're talking about a BIG player in the game.:smokin:

even still its nothing but taxpayer money for them to post up and catch you trying to ditch your wares. physically or video surveillance. usually for drugs though they are coming in with a warrant there is no knock at the door unless its coincedental.

Telephonic search warrants are actually rather common and can normally be fairly easily obtained by officers within a half hour. Depends on your jurisdiction though.

like if your growing a mj plant and they happen to come by. It would be very rare considering i don't smoke just deal and only have one plant. I just dont want my ass in jail thats all.

Well if they happen to "come by" and the plant is in plain view from a place in which they had the legal right to be walking or standing they don't need the search warrant. Although if it is through a window they usually play it safe and get the search warrant first.

nah its in my closet and is highly conceled they'd have to search through a bunch of boxes and shit. they never come by i just need to know if they do how much time i have to clear all the weed out of my house.
