They're threatening any MMC who serves a patient in the 35 day waiting period.

That was my first thought, sort of a double standard isn't it? Do as I say, not as I do. :(

indeed
every week they try to lay out some new rule to protect the fine citizens of colorado as an attempt to impede the progress of this industry. fine have your mmj were just going burden you with regs and red tape.

Technically, the 35 day rule has always been in place.

true but that wasnt really what was getting at its always something with these people. so now, one wonders how are they going to enforce this. place their own employees as armed auditors in each dispensary

If the state ever gets around to denying applications, then any MMC that sold the 'denied' person medicine during that period of time would technically be selling to a non-patient, which is illegal.
It's inconvenient, but so is everything about this legislation. Oh well, I'm just glad I can medicate.
Although, I will be slowing down my MMC visits since they are starting to ask for redcard and id, then showing it to recording video camera. I don't care to have anyone know how much I visit, and my MMC's will suffer for it.

Every MMC will be hooked up to a camera system that will be accessible at any time by _____, I am not sure. We're told that this system won't track amount purchased, but I have concerns about my trips to mmc's being recorded. I have a public image in my other life.

I'd love to get in trouble for dispensing medicine to a patient who hasn't received a denial in 35 days but eventually is denied. Hello, lawsuit! The CDPHE knows it, too.
Same for if any of my confidential information. The concept that patients will be persecuted in any way to me seems to be unlikely.

Technically, the 35 day rule has always been in place.
My understanding was it became in place because of 1284. Once you get the rec, under a20, that is all you need. Before 1284, the mmcs were operating like big caregivers. Now with the "mmcs," they have to have 35 days.

Again, my understanding is that after 35 days you are automatically approved. They can't deny you. I would love to see a patient filet them on this.

As a center trying to follow all laws, I appreciate the clarity from Matt Cooke et all. That said, I don't understand this section of the law at all. If MMJ is helping people who are in pain, how can patients be expected to wait 35 days?
Oh I'm sorry you just ruptured your disks in a car accident. We'll see if medical marijuana can help you in a month or so. Until then maybe ice or something.

Like I said, it was technically in place. As "big caregivers", as you put it, we could raise an affirmative defense. Now the protection we had under A20 is gone. Pretty sure we're saying the same thing. Although, according to the city attorney, they'll prosecute anyone in the first 35 days, regardless of where it was purchased. I brought up the aff defense, haven't heard back yet.
I was denied after 35 days because of a problem with the notary. I consider myself approved.
