Ok so the State rejected my application due notary's mistake. The state sent all of my info back with a new application saying to corret the mistake and send the app back. so what about the 60day period from when the doc signs it and you send it in? i saw the doc 5-4-10 and they opened my info in 6-14-10 but i got everything back in the mail today(the letter they sent back is post marked 8-30-10).
Thank you for you help.

They rejected my 75 year old mother because she didnt include a photo ID of her caregiver although she mailed it before they implemented that rule. Took them 2 months to send it back so the doctor recommendation was no longer valid. This was about the same time the DOH was telling the media the average card holder was 21 year old males.

(d) Except for patients applying pursuant to subsection (6) of this section, where the state health agency, within thirty-five days of receipt of an application, fails to issue a registry identification card or fails to issue verbal or written notice of denial of such application, the patient's application for such card will be deemed to have been approved.
I really want someone to call them on this. Since they didn't respond, you should be approved no matter what.
Tell them that the 35 days are past and to issue your card. Then take it to court when they don't comply. I realize you won't do this, but would love someone to shove it in their face.
I sent my in Dec last year and just got it this week. Fucking bullshit, but I did get 8 months free i guess. I will never pay the state again for a card. All you need is the rec from the doc, unless you want to shop in an mmc.

"You have 60 additional days from the day we rejected your application to re-submit it to the registry without having to get a new Physician Certification.
Thank you,Ok so if they opened my app. on june 14 2010 (the date is marked in red stamp on the cover sheat) and I got it back in the mail on august 30th 2010 (its post marked) then how do i have 60 days to correct the info and mail it back? GOD!

From the email you received back, I would say you have 60 days from August 30, 2010 (your rejection letter date) to resubmit your application. I would also include a copy of the email you mentioned above and their rejection letter in your resubmission packet.
Good luck!
