Medical Marijuana Dispensary Fights Westminster Ban - Denver News Story - KMGH Denver (http://www.thedenverchannel.com/news/24585196/detail.html)

WESTMINSTER, Colo. -- "We are doing nothing here but providing a service to a state-recognized right," said Carl Wemhoff, owner of Herbal Remedies in Westminster. The medical marijuana dispensary opened in June of 2009, and has continued to serve patients, even after the city voted to ban this type of business in December. However, this action came with consequences.

"They've filed 783 criminal charges against me, at my home no less, and it started the fight," Wemhoff said.

The fight is a legal challenge of Westminster's ban on dispensaries, and to Colorado house bill 1248, which seems to grant this right to cities and counties.

"In H.B. 1284 they seem to write in language that creates a permission there," said Tae Darnell, an attorney for Herbal Remedies. "However, not all legislation is good legislation, and this legislation is in direct conflict with the constitution."

The state constitution provides complete exemption from state criminal law for patients and their primary caregivers regarding medical marijuana. This suit could benefit dispensaries across the state. Darnell said Herbal Remedies has the moral support of the medical marijuana community, but financially, it's in this fight alone.

"We are going to be stubborn about it. We'd probably save a lot of money and just do what they would like us to, but personally I don't feel its right," Wenhoff said.

In a written statement, the city of Westminster says it "unanimously determined not to permit medical marijuana dispensaries to operate in the city and is determined to enforce these and all other city ordinances when required to do so."

I liked Carl when he had his little delivery business going but greed set in when they opened Herbal Remedies with their $50 clones and $70 eights.

Zedleppelin is right Carl was great when he had his delivery service.Prices very very fair and his meds were always good.He started out being my caregiver.Then he open up his disp.and things really did change he would sell the large buds for up to 30 gr. .You can not see any jars.He has a vending machine that has eights and qts already baged up.If want a z you get 4 packs of qts.I wish him well !!!

Wow.

Not sure that dispensaries were really behind the push for this bill. I believe it started out that way with some common sense regulation, but the bill went to the dark side when Romer and the gang sold out the shops and the caregivers.

Maybe I'm wrong, but I don't really believe that dispensaries hate on the caregivers like you project. Everybody provides some viable service in this industry. Some patients want dispensaries, some want private caregivers.

It seems that you are pissed at the law and new limitations, and blaming it on the dispensaries. Maybe you should consider that it was the legislature [Romer] that pushed this law and it's limitations, not the dispensaries.

The law is what it is, we all have to deal with this mess. Calling dispensaries a bunch of pricks that sold you out is just wrong.
Not that I feel the same way as dixierebel, but you know there were at least a couple big dispensaries pushing for this bill. I find it really hard to believe there was no lobbying to take over a multi-million/billion dollar industry.

You can thank Wanda James from CMMR, Matt Brown, Warren Edson, and Josh Stanley. They approached Romer with this idea, Romer gave up trying to get anything passed until he was contacted by these evil greedy bastards. You can thank them for taking food from your kids and anyone that does business with any of them is scum. Boycott Apothecary of Colorado and 8 Rivers Restaurant, both owned by Wanda. This was her fucking brainchild.
