As you may have already heard the department of revenue is giving the mmj community miss information on several issues just hoping to catch a shop sliping so they can hang them by the neck. Just about a week ago matt cook sent out an e-mail stating that shops where required to stop buying product from vendors on july 1st, but he said not to worry that they would not be enforcing the new law until aug 1st. Then two days ago the department of revenue decided that they are not going to be easy on the july 1st rule and they are enforcing the anti vendor law at this very moment. Just to let people in, they are sending in undercovers to catch shops off guard, and if they catch you you''''''''''''re done. You can never work in the industry for the rest of you're life so beware!!! This is nothing new as I have learned by example. The Department of Revenue loves to give people deadlines and then behind the community's back they change the dates so people are left out in the cold and are now in violation and are breaking the law. They used this tactic to shut down most of the shops in colorado. It is apparent to me that our state and our country dose not want it's citizens to be able to take care of themselves. The government wants people dependent on the well fare system so they can control us and it can assure that we will vote for them, period!!!! This industry was going to change the face of colorado for good and employ so many people it is not funny. They do not want us to flurish, only struggle and just scrape by. It makes me sad that most in the community sat by, as our so called government took our rights away from us without even a whimper. The time has come to stand up and vote these bastards out that supported hb 1284. The people that think this is a good bill need to check there motives, because I bet they either own a mega dispensary or just do not get it, period. I would like to say good bye to jeff at herbal element, one of the best spots in the state. When I came by his shop the other day it was closed for good , then it hit me, man we are about to loose our ability to choose what meds we can get. I think the community is in for a shock if they do not think the quality of mmj is about to fall off big time. I am just sad at the state of things and I just wish it could go back to the good old days, when people could do what they wanted just like ummm o yea that is it, capitalism.:rastasmoke::mad:

Too bad too because Colorado was really "leading the way", cough, cough.

The dispensary owner at happy canyon and santa fe told me wednesday, that a MMC in parker got busted that day for selling to a patient.

The patient did not have a red card, but had the paper application. The reason the MMC got busted, was because the patient didn't have, or the MMC didn't require/request, the proof of recent mailing or whatever is required with paper applications now.

But I haven't seen any other evidence of a bust. I didn't even know there was an MMC in parker.

That sounds like VERY close scrutiny. Do the inspectors stop in everyday in Colorado?

As I understand it, if you submit a paper app/doc reco instead of a red card, you also must provide proof of mailing more than 35 days ago or something.

The issue was the minor fact that the MMC didn't require proof of mailing, which is required. So the MMC was in the wrong, and deserved it.

However, it's important to note that the original poster never provided anything more than a story he heard from someone else.

You'd think an MMC bust would be in the news or police blotters, etc, but I know there are regular busts in brighton and they aren't mentioned outside of westword.

I hear you my friend, same sentiments exactly! Hang on though they arent going to beat us we know that RIGHT, were too strong now there might be quirks needing to be ironed out but all in all look at the positive where we've all made it so far, I hear you though thoroughly, you're right it's the greed that the system tries to control for their benefit, I think basically greeds the bottom line that's the fuel behind the system,ya know? Sorry to hear about your friend that had to close his clinic, it's good that you're spreading the word like you did about the way the wool is pulled over the eyes by the system, fortunately for us the only way they can pull somthin like this off is by trickery and miss information, they need to remember something what comes around goes around, keep your chin up,cherokee

I agree whole heartily.

Things to remember:

Senator Romer promised to close 80% of dispensaries down. He does not care about patients rights or anyone.

Senator Joyce Foster, who was the chairwoman in the last hearing, said on record that "it's probably not the best way to put/say this, but how do we put the genie back in the bottle?" as she questioned law enforcement from Adams county.

She and everyone on that committee should have been impeached as they all took an oath to uphold the language in the CO constitution and here, on record, she was trying to stomp on it.

1284 changes cannabis from schedule 1 (no medical use) to schedule 2 (meds that can ONLY be dispensed in pharmacies). The ma and pa has lost again. Thousands of people who had work will now be criminals and we loose to the Corp once again.

And worse yet, the state is going to take hopeful MMC's money. Come Jan in the next legislative session the people will be told they have now had time to carefully review the language and no one gets to be an MMC. To apply to be an MMC:

One will give up ALL privacy rights under state and federal law.
One will sign over their power of attorney rights to the CO Dept of Rev.
One will be signing a confession to a federal crime, with NO protection for MMC's in the CO Constitution which includes a neat little list of all one's assets, including children--which almost doesn't matter since one's power of attorney will be in the hands of the CO dept of rev.

Lets examine one sentence on two of the release forms:

"Any information contained within my application, contained within any financial or personal record or otherwise found, obtained, or maintained by the Investigative Agencies, "(notice it's plural) " shall be accessible to law enforcement agents of this or any other state, the government of the United States, or any foreign country."

Are you kidding me? What is amazing and Un American is that about EVERY sentence of the 22 pages will make a true American sick to their stomach. And nothing yet in the press. And who owns the press? Americans are F#cked.

It's hard to be optimistic. We did not turn out in the streets by the thousands and demand what we voted for. Most still are clueless that most dispensaries will be closed down. Patients will suffer. :( And everyone's constitution means less and less.

Kathleen is right on this one. Here is the text from 1284, though:

TO BE CONSIDERED IN COMPLIANCE WITH THE PROVISIONS OF SECTION 14 OF ARTICLE XVIII OF THE STATE CONSTITUTION, THIS SECTION,
AND THE RULES OF THE STATE HEALTH AGENCY, A PATIENT OR PRIMARY
CAREGIVER SHALL HAVE HIS OR HER REGISTRY IDENTIFICATION CARD IN HIS
OR HER POSSESSION AT ALL TIMES THAT HE OR SHE IS IN POSSESSION OF ANY FORM OF MEDICAL MARIJUANA AND PRODUCE THE SAME UPON REQUEST OF A LAW ENFORCEMENT OFFICER TO DEMONSTRATE THAT THE PATIENT OR
PRIMARY CAREGIVER IS NOT IN VIOLATION OF THE LAW; EXCEPT THAT, IF
MORE THAN THIRTY-FIVE DAYS HAVE PASSED SINCE THE DATE THE PATIENT OR PRIMARY CAREGIVER FILED HIS OR HER MEDICAL MARIJUANA PROGRAM APPLICATION AND THE STATE HEALTH AGENCY HAS NOT YET ISSUED ORDENIED A REGISTRY IDENTIFICATION CARD, A COPY OF THE PATIENT'S OR PRIMARY CAREGIVER'S APPLICATION ALONG WITH PROOF OF THE DATE OF SUBMISSION SHALL BE IN THE PATIENT'S OR PRIMARY CAREGIVER'S POSSESSION AT ALL TIMES THAT HE OR SHE IS IN POSSESSION OF ANY FORM OF MEDICAL MARIJUANA UNTIL THE STATE HEALTH AGENCY ISSUES OR DENIES THE REGISTRY IDENTIFICATION CARD.

Isn't it 1500 patients that designated her as primary caregivers? Would retail walk in customers be included in that number?

I'd assume the latter, but I'm not sure. We've had 2800 patients come in to date, but not all of them designated us their state registered caregiver.
