Trying to stay legal but im not to sure where my other patients are going to go or how long i can keep them on with me.

which lawyer told you that? Ive talked to 3 different ones and they all had different answers so im not sure what to believe anymore.

Can you tell us what 3 different answers you have received? I am hoping that it is July 1st 2011 but have been hearing next week as well. The only good thing about it kicking in next week is that the lawsuits can start flying as well.

Ive heard that part of the bill doesnt take effect until july 2011
Ive heard that the caregivers with more patients will be grandfathered in.
Ive heard "i have no idea WTF this bill is going to do or when most of it starts"
According to the DA of Adams County "Im not aware of a 5 patient cap on HB 1284"

I haven't heard or read in 1284 that caregivers with more patients will be grandfathered in?
"A person shall be listed as a primary caregiver for no more than five patients on the medical marijuana program registry at any given time, except that the state health agency may allow a primary caregiver to serve more than five patients in exceptional circumstances. In determining whether exceptional circumstances exist, the state health may consider the proximity of medical marijuana centers to the patient." Page 60 (6) of 1284
Prior to July 1, 2011, a county, city and county, or municiplality may adopt and enforce a resolution or ordinance licensing, regulating, or prohibiting the cultivation or sale of medical marijuana. In a county, city and county, or municipality where such an ordinance or resolution has been adopted, a person who is not registered as a patient or primary caregiver pursuant to section 23-1-5-106 CRS and who is cultivating or selling medical marijuana shall not be entitled to an affirmative defense to a criminal prosecution as provided for in section 14 of article XVIII of the state constitution unless the person is in compliance with the applicable county or municipal law. Page 5 (2) (a) of 1284.
(c) On and after July 2011, all businesses for the purpose of cultivation, manufacture, or sale of medical marijuana--infused products, as defined in this article, shall be subject to the terms and conditions of this article and any rules promulgated pursuant to this article. Page 5
I haven't read yet--where they have given an exact date for caregivers to go "down" to 5 patients?

Without a date certain for caregivers to go down to 5--it kind of looks like it is July 1, 2011.

ok so I understand I have to drop patients...which I am not happy about...so lets say I drop all of my patients down to 5. Can I grow for my 5, my wife grow her 6 plants and my room mate grow his 6 plants essentially bumping my plant count to 7 patients, but technically only carrying 5? still far cry from my patient count now, but I just want to be able to helping the best I can as limited as I may be... :(

Your are allowed to grow for 5 patients and that is it. You cannot have more then one grower in the same house growing on the same property. I had this same question about a month ago and Corry and another lawyer told me only one grow operation per residence and your wife and roommate are not allowed to help you in the grow room.

actually the part about a man and a wife sharing grow space hasnt been hashed out yet. Well not sharing actually but the wife having her grow space and the husband having a separate on the same property.
