I noticed my $90 check just got cashed - I sent my paperwork in mid-Feb - anyone be so kind to tell me if they got their card shortly after seeing check cashed or does state cash 'em and then let the apps sit again? Thanks for any info.

they wait for it to clear, then it goes into the next pile.
I think it was 30-60 days after cashing on the last card we tracked a couple months ago.
I've been hearing they are coming right around 6 months to the day... I think most checks become uncashable at 180 days... so they have LET it go as long as they can, still being able to collect the $$.

and.... you can write or call them to ask.
they need more of that going on. when customer service because of the delay starts being more of a PITA, perhaps it will improve...

My application was received by the DPHE on Dec 17th, 2009. check was cashed March 22nd, 2010.
I have yet to receive my red card. On May 27th I sent an email to the head of the MMJ registry and surprisingly I received a reply very quickly.
I was told that applications which were received Nov 19th, 2009 were just now being processed on May 28th, 2010.
Hope that helps. It looks like I'll receive mine at the end of June or the first week of July.

I sent a email the other day asking about when (time frame(i.e apps received in January)) they are processing. about a week after sending the email all I got was a link to the wheres my card page. Guess they are to busy to even properly answer a question.
I sent my app in early January & we have cluster mail boxes here, and since I am disabled I was trying to get an idea when to start watching the mail more carefully. As it is now I am lucky to get to the Mail once a week.

At this point, who knows? As of June 9th, 2010 from budget change request for "emergency" funds:
"The registry does not have sufficient staff to meet this volume and the backlog is continuing to grow. Amendment 20 requires the Department to reject an application or to issue a registry card within 35 days of receiving the application. As of June 9, 2010 the backlog is:
â?¢ 63,100 pieces of mail that have not been opened.
â?¢ 31,400 applications that have been evaluated (accepted/rejected) but the data has not yet been entered in the system.

well, you could always just not send it into the state right? I mean affirmitave defense. We are all so quick to say "ohh it's in our state constitution" well nothing in the constitution says anything about a registry or registering. From my interpretation and from dispensary owners in Boulder I spoke with in the past, you are legal with your doctor's signature on the form. Nothing at all about registry making you legal, or your card making you legal. Granted cops can still screw you for it, but that's why it's affirmative defense just like religious defense, but imo affirmative defense medically would be more valid..Not that I really care, for the time i did use mmj i only used my physician cert. and that didn't stop me from obtaining mmj from any dispensary. I don't use drugs anymore including Schedule 1 drug mmj (yes i know it's bs) just doesn't work for me personally anymore. Not to mention receiving laced product from a dispensary. Good Luck ALL! but imo especially with the way things are, i wouldn't want to be on a registry, and glad i never was. Did y'all know that plenty dispensaries "standard" paperwork includes a form that lifts the privacy laws on your information so the dispensary owners would then own it and then be able to potentially sell it to 3rd parties without violating any privacy act?? Hope everyone read the fine print!! i know most wouldnt care as it's your lifestyle and you want ppl to know how you feel about mmj, but personally i wouldn't want to be applying for a job in the future when employers begin purchasing and checking lists of names of people who had cards and were sold those lists by dispense owners who had your signature releasing your privacy rights. Cause be SURE that in the future most big employers WILL be checking that if they are against it. And there DEFINITELY will be people selling names of "mmj users" that used their dispensary to make more money from employers or people advocating the fact of "know whether your potential employee has ever used mmj or been to a dispensary" now that's a quick way not to get hired. If you even care that is.

This makes me scratch my head... Have you read the state's constitution? A20 deals extensively with the registry and registration. Why would you make such a claim?

I'd be fine with waiting up to a year if they're going to date them from when they're sent. You're getting a year and a half for the price of one right now!

I was told by both Lauren Davis and Rob Corry the state registration is optional, all that was needed is written documentation from a doctor saying you would benefit from MMJ. Although having a card is an added layer of protection and less hassle if you had to deal with cops the end result would be the same. I'm really not sure how they arrive at this since it does mention the registry in the amendment.

Is this after 1284/109? I thought that the new legislation REQUIRES caregivers to register with the state? Again, doesn't the legislation deal with MMC's and caregivers more than patients?

A. We are talking about patients.
B. 1284 cannot trump a constitutional amendment.

I have tested the validity of the card twice now. Once roadside, once on my front doorstep. Both times it protected me from arrest and actually garnered me respect from the officer who was sticking his nose in (what they now know is) my business. I shudder to think what would have happened in both situations had i showed them a copy of a form that can be (and is being) printed directly from the Internet and easily forged.
how far would you get dealing with the "authorities" if you failed to have a valid license in these situations that are also governed by the State?
Operating a motor vehicle
hunting/fishing
serving food
acting as a physician
acting as an attorney
operating heavy equipment/trucks for hire
opening a pharmacy
opening a dispensary
I always operate under the fact that "my attorney" will not be sitting beside me in jail when I think about such things. If a license is available to you and you do not complete the process it will cost you a pretty penny and you will take a big risk overall in court to have your rights upheld, if in fact, they are upheld.
So who wants to test the law? Please report back with your findings and how much Corry made off of you to provide such info!

It seems like you are taking the viewpoint that you somehow can't get in trouble if you are A20 compliant but not 1284/109 compliant.
Would you please clarify? Are you saying if I have 100 patients as a caregiver, legal under amendment 20 and illegal under 1284/109 that I can't get in trouble?
Or are you still referring to the affirmative defense if arrested? I think it's important to note whether you are saying to ignore 1284, or that in court, it won't hold up.
I guess I might be naive, but if I am not compliant with 1284/109, then I could get arrested or otherwise get in trouble. Are you saying that's not true? Are you saying that 1284/109 don't have any legal authority, no teeth? It kind of seems that instead of the dept. of health overseeing things (joke), now that the dept. of revenue will handle enforcement will not be a joke with enforcement.
Thoughts?

I mean, really. They have to review the form then type 10 fields of data into a database. They get paid $90.00 to do it as well.
This is intentional delay on the behalf of the Health Department. Somebody needs to pull this task and the associated windfall away from them.

Thanks, Know a couple people who send theirs in also at the end of January & February. I thought the wait was closer to a year, though 8-9 months still is a long wait. Nice that they are still putting the issue/expiration date of sending it out and not when they received it. It was rumored that they were going to change to the date received.

Why are you guys being so hard on the Dept of Health??
They only have $9 Million in the bank! How can they afford to hire more staff to process these cards faster with those paltry funds??
Hopefully they will raise the fee soon so that Ritter can raid their account to balance the state budget.
My stats: Application submitted last March. Check cashed a few weeks ago. No card yet. Thanks for the info guys - silly me - I have been eagerly checking the mailbox daily.

those paltry funds as you so eloquently put it was used to buy a 100 keys so when they get to work they bring a bag out and get ripped(the real reason it takes so long to get your card) and squandering the rest on politcal luncheons, rubbing shoulders with societies elite and debaucherous orgies in the conference room. truly charlatans of the highest caliber. dont even get me started on the raising fees thing, im sure they only have a pound left and that wont last long:D

Submitted mine March 25, 2010 in person at CPDPE w/ a Western Union money order.
Yesterday via mail I my got card dated Sept 27, 2010. It is valid until Sept 27, 2011.
Took almost exactly 6 months.
Bty: for those that do not have an actual card yet, it is an 8.5" x 3.5" certificate (sort of like a car title), that has creases in it to allow you to fold it up into business card size for your wallet

They are prioritizing denials right now, and there are a lot with the new restrictions SB109 put into place. It's the area where they have the most to lose with potential lawsuits. The good thing is cards are still being dated a year from issue, so they can take all the time they want.

If you, or one of your patients, have paperwork older than September then something is wrong and you need to call the registry. 90% of the issues patients are bringing in relate to a move during the time their card was processing.
The post office won't forward the cards. They go back to the registry and sit in a stack until the patient calls in to find out the story.
Call them and you will have your card in a week.
