View Full Version : Nederland to Craft Stronger Marijuana Laws that protect Patient Rights!

We have contacted all the members of the board of trustees and they are all on board to save the town of Nederland from the State. 1284 with the 1000 ft rule from any school pre school or church puts all 7 Nederland dispensaries out of Biz. We will not drive to the big metropolitan areas for our meds! If needed Civil disobedience will occur the shops will stay open until we are arrested and we will vow to keep re-opening, we will not take this sitting down (unless it's in the streets to block all traffic from coming into town).

I wondered how the smaller towns were going to fair with this rule. It's obvious when they were dreaming up all these rules they were only thinking of the big metro areas of Colorado. Small towns just don't have the room to be 1000' from schools, preschools, etc., etc....

if so, opt out of the bill completely and remove the felony exclusion!

this is what will need to happen. unless you are a home rule city, you cannot opt out of state law.

just got the paperwork delivered to petition for home rule, we only need 68 signatures (a benefit of a small town). :thumbsup::thumbsup::thumbsup:

kickass. Congrats on something that could work.

I'm surprised Ned wasn't home rule already. It would put all local taxes back into the town, instead of splitting it with the state. Downside is there is lots more to pay for on the local level.

Personally I do not see that being legal. State laws rule over all county laws just like federal laws over rule all state laws. I would be willing to bet if you have a dispencary within a 1,000 foot of a school the state will step in and arrest you and pad lock your doors.

The only way a city or county can have something different is if when a law is written the state allows for a city or county to be able to vote or allow this or that.

Kind of like in the law where the state makes mention to the fact a city or county can decide is they want store fronts to be able to sell marijuana

The state is very clear cut on the 1,000 foot rule when it comes to schools. I also think there are certain law enforcement officer that are bitting at the bit to close down dispencaries.

Good for the state for being so clear cut...now how about those employees of ours (the state government) listen to US, their bosses. Frankly I no longer recognize any law not petitioned for and voted on by the people. The House, Senate and leo can all suck it. Take the country back, start with our state.

Wrong in this case. The 1000 foot rule includes a local option. Any city, town or county can opt out, home rule or not.

I would say read the law there is an opt out clause for any town, Colorado home rule law does apply according to Corry the State can't have it both ways, they cannot let some cities ban it outright without letting home rule towns allow it outright.:thumbsup::thumbsup::thumbsup:

Great news from Corry on this he has agreed to meet with the town Tuesday.
We will try and convince Nederland and some other small towns to join corry's suite.:thumbsup:

Yes, and Netherland can enforce a lesser rule. There are many small towns in this state--that could never reach the 1000 ft. dispensory rule--and other towns have already addressed that issue down to 500'.

Any news about any laws filing suite or trying to get any injunction even though we know a injunction is like trying to win the lottery?

If any civil case are getting ready were can we make a donation and what are the main issues that are going after? I am sure it is best to just pick a few instead of everything

i'd say the very first thing to deal with would be the 5 patient rule.the caregiver to caregiver part and the 70/30 bs.patients need to be able to be free to get meds from any caregiver not just 1.2nd the whole we will be in your biz every 5 days that needs to go to.

it really was mind blowing, it seems like the BOT are really trying to protect the small growers in both the business and residential areas in town. It's grate to live in a town where this is possible.:jointsmile:
