View Full Version : MMJ License. What do dispensaries require?

For purchasing purposes, I know that the application has to be notorized to send it to the state but when making a copy of this application for my "temp" license, does that copy have to have an original notory on it too?

Just make a copy of everything that you're sending to the state. Recommend that when you mail it in, mail it either certified, registered or at least with delivery confirmation. Make a copy of that receipt too. All those copies should suffice most dispensaries, if not all now.

I sent my paperwork in the end of December 2009. They cashed my check April 9th. I have never gone to a dispensary but my friend told me my copy had to have an original notory stamp/signature too. I haven't read that anywhere.
I was just curious in case I did wander into a dispensary.

When it comes to the so-called HIPAA forms, I usually cross-out what I don't agree with and mark N/A next to it. Never had a dispensary turn me away yet. Of course, I think they just usually just check for signatures when I turn my forms in.

Always read anything you sign but remember a change of caregiver does require your signature to be notarized.

What's the reluctance to sign HIPPA forms? We get this all the time, but I can't for the life of me understand why.

Are you sure you not talking about the "temporary caregiver" parts on the forums? I know the way they read sometimes makes it seem like they saying that they are your primary caregiver but what it actually says is that they are ACTING as your primary caregiver for a temporary time. I try to make sure I'm not baked when I have to sign and read all that jargon but I have talked to at least 10 different dispensaries about it. That's how they are able to sell you "meds" in the first place. It's a loop hole and it's not hard to see, or maybe it is and I'm smart.
Speaking of reading, have you read you temporary paper's/license? NO WHERE on your forums does is say you should goto a store/"dispensary" or that you can even buy medicine. All that your forums you send into the office DOES say is that some DR. you knew reviews your records, says you're undergoing treatment of said disease(S) and that same Dr. Recommends you could TRY mmj to POSSIBLY alleviate your symptoms (EXACT QUOTE- "I have assessed this patients medical history and current medical condition, and I conclude that this patient MAY benefit from the use of medical Marijuana. THIS ASSESSMENT IS NOT A PRESCRIPTION FOR THE USE OF MARIJUANA) .
That's it. Well, I think that's interesting :wtf:
Further more on the first page there's a big FEDERAL disclaimer saying it's not a guarantee against prosecution, and that any consumption, production or possession is a CRIME FULLY PUNISHABLE IN COLORADO.
Don't even get me started on dispensaries and their shitty attitudes/catches. be careful about their advertised "deals" too. I think the majority of businesses are ripping people off. Releaf (still one of my more favorite spots) just for example, advertises a free edible first time in (or at least used to), didn't happen- also if you refer someone you get "free medicine" I've brought in 3 different people all buying "A" grad medicine (as was I) and didn't get shit. That's right, no free medicine for my referral service or any free edibles for them. Was I ripped off? No, but I was made to believe otherwise which sucks because I look bad to my friends for releaf not coming through :mad: :(
on a side note: The price has got to come down, "primo" or not. I've seen places selling swag grade weed for 40 an eighth. If your charge more than 50 and eight for "top shelf" which is "street price", you are robbing from the very people that enabled you to open your business. And street weed has dropped in price (I bought a GREAT bag last weekend for 40$) and almost leveled in quality(it was fire!), then again, Herb will always be around, their businesses won't.
I need to go check out herbal elements, but I think CAM does for me, in Potency/Taste/Smell/Looks/Price/- ok ok ok ok ok, I gotta stop.

For one, HIPPA doesn't even apply to dispensaries so it's a moot point to even bother having those forms. Then most of the places around town have those generic attorney drawn "HIPPA" forms stating they will share your info with the likes of DA, LEO, etc..., without standing up for their or my rights. I personally would prefer to read a statement from the dispensary stating they will keep my info private and only share it with LEO, DA, DEA etc... with a proper warrant. As a former military member, I get upset that places just want to throw my rights immediately in the toilet. This is why I ate sand for years, why I put my life on the line, why I got shot at, why I pushed myself & permanently injured my body for...just to have places flush their & my rights down. Heck no! (stepping down from soapbox, carefully as I have a bum knee...)
All a dispensary really needs is a simple agreement with statements for one to initial besides. Such statement as "I will not use product in or around premises", "I will only use in the privacy of my own home", "I will not distribute", "I am assigning temporary caregivership while on the premises", "I allow said place to verify my registration", etc... A space to fill in my name & address as it appears on my card, my registry number.
I hate it when copies are made of my paperwork. There's no reason for that either. I see this as the number one flaw with dispensaries here in CO. This is what's going to be them in trouble. It very clearly states not to make duplicates of paperwork. I do understand that most of the dispensaries in town have just gone to the same couple of lawyers who are trying to make a buck off all the confusion.
There really needs to be a 24 hr registry verification hotline. If the State won't do it, I hope someone steps up and creates it. It could be something that patients could sign up for for either free or nearly free annually. It could be a service that dispensaries could just pay a monthly fee to join. Even if the service isn't 24 hr, maybe just 7am - 9pm, that would still be better than what dispensaries have now!
ReLeaf - I haven't been into your place yet (did happen to drive by last weekend, and saw your sign so I know now where you're at), so I don't personally know what forms you all require to have someone sign. If you want, I would gladly stop by and go through your forms, and point out anything that I think is BS (read: constructive criticism). I'm not an expert but I do work in healthcare, familiar with HIPPA, and a privacy right nut! :thumbsup: Thanks though for putting your necks out. You and other places are treading on a very fine legal line. I definitely think there's a place for dispensaries and overall I'm happy to see them. Hopefully the good outweighs the bad and legislation doesn't occur which puts them out of business.

When ever I visit a dispensary in Denver for the first time I am greeted with a pile of papers to fill out including 3 HIPPA forms. Consistantly I find something that speaks about making the dispensary my caregiver and consistantly I call them on it. The response I get is that the dispensary's lawyer made the forms and in many cases those handing them out have never really looked at them closely.
The issue is that NO ONE really understand what has to be done at this time. The regulations vary from city to city and they are unclear on a state level. Many places are just attempting to second guess what will happen and try to be proactive. Can not blame them for that, they just want to stay in business. I will applaud that effort.
Untill everything becomes clear it is once again the patients responsibility to read what they sign and ask questions. Remember that a change of caregiver takes a notary to confirm your signature so unless they are doing something shady and diffently illegal they will not submit a change of caregiver. I have more issue with all my personal information being handled by people I really do not know. I will not place my full social security number on a dispensary form but have been asked for it numerous times. Don't mind giving my email but not exicited about my phone number.

I know right! Who would be dumb enough to give their SSN out to anyone besides a government office or a financial institution!
As far as phone & email - I got a Google Voice number just for this, along with Gmail account.

Did they give us your name, or were you with them when they signed up? We flag any referrals in our system and offer free meds next time you come in. If they didn't leave us your name, or if they were referred before we started the program, there isn't much I can do for you.
I can promise you I give out so many free eds/meds, it makes my head spin. Let me know the amounts they purchased and I'll get you the free meds and edibles. Sometimes we make mistakes or things fall through the cracks, but I appreciate you calling us out on it. Ask for me next time in (Jake) if it's Mon-Fri or Zac on the weekends. I'm really sorry. We try to deliver 100% on what we put out there and it's frustrating when you feel like you have to tell a dispensary what you're entitled to. We should be doing that, regardless. :thumbsup:
