Although Alpine Medical LLC, a medical marijuana dispensary, was open for business on Feb. 27, the doors soon could be forced shut.
On March 10, the town of Elizabeth filed a conjunction to the Elbert County Courts to cease the operations at Alpine Medical. Town administrator Chris LaMay said the business did not obtain an approved business license before a 6-month moratorium was put in place banning all medical marijuana dispensaries in Elizabeth. He said because of the lack of business license, the business is in violation of the moratorium and must stop all operations.
??We are waiting on state legislation before we make any decisions, that is why we installed the moratorium,? LaMay said. ??Alpine Medical submitted their application prior to the moratorium but was not granted the business license.?
But Alpine Medical co-owner Darryl Speery disagrees with the town. He said he applied for his business license and received a temporary license on Dec. 17 and was told he would receive the permanent license within five business days. He began construction on the building, at 724 E. Kiowa Ave, suite 8, but never heard back from the town. On Jan. 5, Speery receive a letter in the mail from the town of Elizabeth denying the approval of a business license. The letter was dated Dec. 28. The following day the moratorium went into effect.
??We were licensed before the moratorium, and we went through all the necessary steps,? he said. ??We have rights, and we are fighting this. We are the ones that made them start the moratorium.?
Speery was served on March 11 and is ready to face the town in court. He said he??s been working with an attorney and is ready to start the process to keep his business open.
??This is not acceptable. If Chris would have called us and let us know about the moratorium we would have worked with them,? he said. ??But at this point we have already put a lot of money into this business, and we have done everything correct, and I think in the end everything will pan out in our favor.?
Alpine Medical LLC provides medical marijuana to patients with medical marijuana licenses ages 25 and over. The business also provides massage therapy and chiropractic needs for patients. Speery said he hopes people in need of medical marijuana in Elbert County can benefit from Alpine Medical by not having to drive long distances for their needs.
