Alright this isnt even marijuana related; I just figured I would share my horrible horrible experience with this community whom ive been a part of for quite some time and pray that no one thinks im some sicko. December 30th I just got back home from spending the christmas at my fathers out of state. A detective comes to my ask telling me he has a search warrent for my computers and tells me he beleives that there is child pornography being downloaded to my residence, I was in disbeleif. Now I wont lie, I used Limewire to download porn and have come across multiple videos which turned out to be child porn, nevertheless right click and delete always seemed to work wonders. Well, they took my cpu in for forensics and on March 1st I got a phone call from the county jail asking me if I would like to turn myself in. Of course I go and turn myself in because I don't want the cops coming to my mothers residence and embarassing her in front of all her neighbors. I found out that I am being charged with 1 count of reproduction of child pornography because the computers crime unit had downloaded it via limewire from my computer about a month before. Well now I am facing possible prison time ( I already spent 3 days in county) and If prosecuted I will have to register as a sex offender... Over one video. I understand that this is a very serious crime; but a mistake is a mistake and should I have to pay for the rest of my life over something so dumb? I mean I never would touch children.. my name was in the paper and everything. Also I am an 18 year old with no prior record of any criminal history... I was just about to go to school and everything and now my lifes all off track once again :(

If I understand you correctly, you were downloading some porn and what you thought was going to be good viewing material turned out to be underage and you deleted it immediately? If that's the case that really is a raw deal as no one is perfect (although some cops go around acting like their shit doesn't stink and they're perfect and pure and when no one is looking they turn out to be the biggest criminals) and it doesn't seem like there was intent. Seems like you have a fighting chance but it is going to cost lots of money and it will be worth every penny. Maybe you and a good lawyer could get your own expert to so it was downloaded then deleted immediately once you discovered it wasn't what you were looking for and let that and lack of intent be your criminal defense.

Cost my dad $1500 to get me out of there, and another $3500 to hire my lawyer, but hes looking into everything as we speak. It sucks but I just wanted to let you guys know how dangerous and serious this stuff really is. I never would have though I would have had the police coming after me for this. What I can't understand is if they have the ability to watch what you DOWNLOAD, why don't they watch for what people UPLOAD? It would be pretty damn clear to me that you made a simple mistake. It's the people out there coercing children into getting naked that are the sick fucks - not people like you just trying to "exercise your prostate", as I like to call it.

I occasionally download porn and have dreaded at the idea of accidentally downloading child porn (and the law kicking down my door at 4am). It's a scary thought that is now amplified after reading this thread.

The justice system shouldn't be able to throw a technicality at you. As humans, we are prone to honest mistakes.

You must download quite a bit of porn to have accidentally encountered that of children's because I don't think I ever have. I think I've only been unlucky enough to have been "rick rolled" with gay porn, lol.

If you knew, you should have securely erased that vid with the Guttmann method plus a slack space cleaner multiple times.

You will need a reasonably good lawyer to solve something like this. I think that you will be acquitted of charges.

BUT my whole point here is the sex law stuff. My poor kid when he was 15 consensually touched a girls genitals who was 2 days from 13, so she was technically 12. He got nailed with "rape of a child in the second degree" and it has totally ruined his life.

He has met all the criteria to not have to register as a sex offender now (he is 22), but unless he can get the governor to pardon him, he will always have the felony on his record and it already has effected his ability to be a counselor at church, finding jobs, and other sundry facets of life that most of us take for granted.

I feel really bad about this, because I made him answer the cops questions and I was not smart enough to see the possible implications. I was just trying to teach my kid honesty and good life skills.

I know one kid who was 27 in there who had 20 counts (obviously it wasn't an accident) of reproduction via limewire (same charge as me but I only have 1) And WITH a plea bargain they offered him 50 years... It is rediculous. He said they were going to give him 100 (5 year mandatory minimum for anymore then 1 video). I agree someone with 20 counts should def get some time, llike a year or 2. But 50? that is just way to excessive.

Jeepers! I didn't know that a 15 year old who did a felony wouldn't have it off his record after 18 years of age. I guess it is more acceptable for a 15 year old to beat the crap out of some one than to explore their sexuality.

Bare in mind, I'm not advocating anything. I like a mature woman, rather than a giggly girl. One thing I think is funny is how times have changed. When my mom and dad hooked up, she was 15 and he was 21. That was 53 years ago. Everyone was in favor of it, and they married when she was 16 and he 22. the way it works fadd is limewire is a ptp dl,so say you go into limewire and search for say an ac/dc song once it's on your computer you are then apart of thew "pool" of servers so to speak. it's peer to peer meaning once it's on your computer whenever someone else goes to dl the same file they leech off everyone that is in the "pool" so you can dl faster.

so even if he dl'd the said file and then did'nt even open it he's already entered into that pool as a peer.note what he said quote" I found out that I am being charged with 1 count of reproduction of child pornography because the computers crime unit had downloaded it via limewire from my computer about a month before".

so from the looks of it this task force sits around and dl's known child porn files from peertopeer sites and whoever they dl via peer they go and trace it back via peer to the person that dl'd it.

so the only way i could see green getting out of this is if said file did'nt have a title dealing with child porn.if it was idk then.there is a way to tell how fast a file was dl'd and or deleted so this can be found out if thats the case.

i know what you are saying but read what i wrote it might make things alil clear in this case. i have kids and i feel the same way infact i think people that do things like this to kids should get to spend a day with me.all off the books if ya know what i mean.but i can def see how things could get twisted and look in a case like this.but like i said in my post above unless the title clearly read underage porn or suggested as such then i can see him getting wrapped up in this task forces bs.

believe it or not i watched an undercover show awhile back about this and the leo's are the ones that repost alot of that shit back online to entrap people weather they are looking for it or not.i myself never even go to porn sites mainly because of that and even more so all the trogans malware,viruses so on that these types of sites are chalked with.online porn is very shady shit.

Whatever you do, dont sign for some ridiculous amount of Probation for this......anything over a year and you should reset your court date through your lawyer. They will come down everytime. Dont sign for any 5 years probation unless YOU KNOW you arent gonna violate for ANY TINY reason. Cause then your going to prison....and lemme tell ya first hand......its the worst enviroment imaginable and NOTHING like HBO 's OZ.....all race violence all the time.
