Hi, I am new in here and I am not familiar yet with all the laws and regulation concerning Medical Marijuana. So I was wondering about how the caregivers can receive their Marijuana.
For example, can they have it legaly mailed it to them, by regular mail, in order to have medical marijuana without having to grow it or to go to a marijuana farm?
In some cases also, if the patients live far away from the caregiver, like in a remote part of California for example, can he get the Marijuana mailed to him legaly?

No. USPS is a federal agency so as far as they're concerned its illegal. But quite a few people mail the stuff, but its risky.

that is good question, sorry I don't live out there so I couldn't tell you but there does seem to be a lot of them. I think if I lived in Cali and had a legal doctors rec I would feel fairly safe using one. Now running one, that would be a whole other kettle of fish. :rastasmoke: Those guys have gotta be taking a helleva risk as are the dispensaries in general. :twocents: It still seems a little grey to me, although they must feel relatively safe doing it as long as they are compliant with all the state and local laws.

If they're using the USPS then its clearly illegal because USPS is federal entity. You could make an arguement that using DHL,FedEx or UPS is legal as long as you don't cross the state line.
Generally if the USPS runs across illegal substances it confiscates them and refers it to the DEA to see if they're interested in following up.
If caution is used cannabis can't be sent through the mail. But just like seeds you risk losing the product.
^ great point, I would never use the USPS to get herb. I think these places deliver personally, not through a delivery service. I would feel safe with that but, yes, don't involved the USPS ever, at least not until they reschedule and make it legal to recieve your med through them. Of course that will be when hell freezes over most likely. :wtf:

This is interesting, me and my brother are both caregivers and like to trade some of our harvests, but have to take the risky and time consuming drive to one another.... we both are medical patients and both live in cali, so would it be good to mail him as long as hes in the same state? That would save alot of hassel... And that letitgrow.com site is awesome! I never knew they had sites like that. But im very skeptical... especially if the FBI comes across that site, wonder if they'd be able to do anything??

go to americans for safe access> legal section> A.S.A. v. Cali state patrol case. It is safe for any cali. patient or caregiver to transport upto 8 oz. at a time.
I would call the A.S.A. for more legal guru info. on this specific subject as they wrote the caselaw on it.:thumbsup:
