Validity of Bartkowicz pot bust to undergo first review « Colorado Independent (http://coloradoindependent.com/47522/validity-of-bartkowicz-pot-bust-to-undergo-first-review)

"Sweetin and his agents were apparently embarrassed. They bombed into the Bartkowicz basement the next day, confiscated 120 marijuana plants and took Barkowicz into custody. Sweetin admitted that the ??tip? came from 9News..."

"Prosecutors Tuesday charged Chris Bartkowicz with one count of possession with intent to manufacture, dispense, or distribute. A conviction carries up to 40 years in prison."

"Under Colorado law, if all 120 plants were flowering, Bartkowicz would need to be a licensed caregiver for 20 patients. If only half the plants were flowering, he would need to be designated caregiver for 10 patients."

I must be reading something wrong. My understanding is that a caregiver can have 6 plants/patient, 3 of which are flowering. If he had 120 flowering plants then he would need to have paperwork for 40 patients. If he had 60 flowering plants he would need paperwork for 20 patients.

Is this right? I'm confused now. :(

Also on February 12, 2010, law enforcement contacted Bartkowicz and asked for his consent to search the residence. He signed a consent to search form. He was also read his Miranda warnings. Bartkowicz also signed an "Advice of Rights" form. During a search of the residence agents and officers were presented twelve marijuana care-giver certificates. Agents and officers also confiscated approximately 224 marijuana plants (approximate 119 in various stages with root systems) and approximately 105 "clones" or "starter" plants.

This guy is priceless.

Whoever wrote that is an idiot? Sounds a lot like the math Bartkowicz was using.

6 plants per pateint, of those 6 no more than 3 mature.

So 120 plants would need 40 patients if they were all flowering, or 20 if they were all vegging

FWIW I will no longer be watching 9News or accessing their website. This is unfortunate as I've been watching 9News for over 10 years.

Thanks Jace Larson you POS tea-bagger!
