ok....i,m goin on vacation and leaving my legal gro with housesitter
relative without a licence(who will water for me while i,m gone)...
.....can the relative legally water for me or is that a no-no?

No that wouldnt be allowed, and he most likely would be arrested if caught watering your plants. If you assigned him as your caregiver he would be allowed to help you with production of your medical marijuana.

legally i think if he's taking care of your house then the plants are in his possession too and he's already breaking the law. so i guess it's not gonna matter much if he's caught watering them. but maybe i saw that on tv instead of reading it somewhere.

thanks for the advice.........somthing to think about for the gardener who needs a getaway.....any other opinions out there on that situation?

It probably would be what they call a "question of first impression" as I'm sure no court in Colorado has decided the question. It's certainly arguable that his status for this purpose should be derived from yours. Unfortunately, if the argument has to be made, someone's already in court, so it's a $20,000 question.:(

we had to go away and needed a caretaker. I'd never chosen one, so we set him up at our address (he lives here most of the time now anyway and he cares) so he is legal, and the count inthe house isn't compromised, and maybe even enhanced.
