Congressman Mark Kirk's love child is this for real I thought we were moving in the right direction, on his web page he relates hi grade medical cannabis to crack... My big question is how does a bill like this get passed do "We the People", get to vote or do we just wake up and this is reality, because they did it at 2:00 AM and added it to some other bill that had to be passed.

A BILL
To amend the Controlled Substances Act with regard to penalties for trafficking in high potency marihuana, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the â??â??High Potency Marihuana Sentencing Enhancement Act of 2009â??â??.

SEC. 2. HIGH POTENCY MARIHUANA TRAFFICKING PENALITES.
Section 401(b) of the Controlled Substances Act (21 U.S.C. 841(b)) is amended by adding at the end the following:

â??â??(8)(A) Unless a higher penalty is otherwise provided in this Act, in the case of a violation of subsection (a) involving high potency marihuana such person shall be sentenced to a term of imprisonment of not more than 25 years and if death or serious bodily injury result shall be sentenced to a term of imprisonment of not less than 20 years or more than life, a fined not to exceed the greater of that provided in title 18, United States Code, or $1,000,000 if the defendant is an individual or $5,000.000 if the defendant is other than an individual, or both. If any person commits such a violation after a prior conviction for a felony drug offense has become final, such person shall be sentenced to a term of imprisonment of not more than 35 years, and if death or serious bodily injury result from the use of such substance shall be sentenced to life imprisonment, a fine not the exceed the greater of that provided in title 18, United States Code, or $2,000,000 if the defendant is an individual or $10,000.000 if the defendant is other than an individual, or both. Notwithstanding any other provision of law, the court shall not place on probation or suspend the sentence of any person sentenced under the provisions of this subparagraph which provide for a mandatory term of imprisonment.

â??â??(B) In this paragraph, the term â??high potency marihuanaâ?? means marihuana with a Tetrahydrocannabinol content of 15 percent or more.â??â??.

With all the things going on in this country these days this is what these guys want to talk about... Here is the thing we are not drug dealers in the way that they would like us to be, no one went to jail at Merk when they came out with oxy's which are so much stronger than say Codeine I did not see it go to committee... And so they talk about this a bit hush hush... For CA this is big news.

bullshit!!! Kush is not always purple!! and who says Kush is easier to grow?!?!? And not only that.. but where I live an ounce of Kush wholesale is $400.. and an ounce of Cocaine wholesale is at least $1000.. PLZ stop comparing Kush to crack.

12 grand for 2 pounds of Kush??? Where the hell do they do that at???

Fuck Kush laws.... I have a skunk strain from back in the day that puts me in a coma its better than any kush I have tired.

Theres more than 1 strain thats kush potent or better.... they just dont know......Right now alot of people are growing and its getting crazy they cant control us all.

In order for this to work MJ would have to be legalized. You cannot regulate a products potency unless you regulate it on all levels.
