hey i was recently assaulted on the weekend and have decided to press charges. It happened for no apparent reason and I was struck about 20 times to the head. The guy never suspected us of being blazed at the time but he found out later that me and the 2 friends I was with are heavy smokers. I have been told by multiple ppl that he was going to tell the cops that we were high at the time. I was not blazed then but am extremely worried about him bringing this up in court. Can the court order to have us tested? and if we fail the test how will it effect the case? It will more than likely take months to go to court but I don't really want to quit, does anyone know what I should do?

1)You being high does not give another individual the right to assault you.
2)Court ordered drug test don't happen because of accusations mad by the person you accused of assault.
3)There is something missing from your story, why did he hit you?
Are you a minor? Was this a person with some type of authority?
Trust nothing I say, ask a legal professional, they usually don't come cheap.

no i am not a minor and the individual who assaulted me had been drinking heavily that night and he was by himself at the time when shit hit the fan.

Its next to impossible for them to force you to get a UA for anything of such a small nature like that.

Yeah, I agree with the above posts... If it's a matter of assault, then that's the most prominent issue. It's actually not illegal to be high, just illegal for possession, growing, distributing, etc. Just be 100% honest, and I hope you're okay!
I was smoking once, and my sister's friend was drunk as shit, he got mad at her, and ended up punching out my 3 car windows! We went to court over that, as he refused to pay the damages, and I wasn't going to put an insurance claim on it because it would have increased my premium. Long story short, told the judge exactly what had happened, and I got the money to fix my windows, and a restraining order against the guy. He was nuts!

the only reason I am concerned is if he says we were too baked or whatever to remember then it could effect if are stories are reliable or not

My friends did not just sit there and watch they tried to get him off but you have to keep in mind we had never been in a fight in our lives and this guy was 25 and we are only 18
but ya I'm leaning toward quitting because court could possibly not be for 2 years and so I have lots of time to get clean

I've been in more than a few bar fights and it's really not worth getting the cops involved man. It never is, unless you wind up in the hospital. Then it's time to call it quits.
I take it you aren't much of a fighter but believe me dude, knocking out his teeth will feel a lot better than pressing charges.

if this happend in the US if you dont press charges right away unless your a minor I am not sure they can do anything now. question is why did he kick your ass, and if it was for no reson why didnt you call the cops and deal with it then. being high is not a licence for anyone who wants to to kick your ass. If you have a big mouth or drunk on his lady thats another story but to be sitting thier and out of no where 3 guys beat the crap out of you that is casue for some concern,(I have seen this) and thats what cops are for, thier's laws in place for this. I would like to kick the shit out of so many people but the law says I cant

First of all, why did he attack you? I somehow doubt it happened for "no apparent reason", and if it was over drugs or something else illegal, I would drop the charges.
If you do decide to go to court, this guy claiming you are a pot smoker won't change anything unless you have been arrested and convicted for drugs in the past. A judge will not order drug testing for someone with no priors based on testimony of the guy who beat the shit out of him!

I agree with the people above. Not to mention even if you were required to take a drug test they wouldn't be able to prove you were under the influence when the attack took place.
As long as drugs weren't involved in and/or cause the fight, I don't think you have anything to worry about. Had he made the accusation when the report was filed it may be a different story, but I think your safe.

ya it didn't happen over anything illegal, the man just simply was ready to fight and after he got in my face for no reason and hit me once to the shoulder i pushed him backwards and then it happened, the man did end up getting a little bruised up but we didnt hit him in the face or anything but we obviously didnt use enough force to protect ourselves because it didnt stop him. but ya i don't really feel like quitting right now because I got a gram of budder. And I am pretty sure he found out we smoked before he wrote his testimony so I am pretty sure it will accuse me in his statement of being high.

I dont know how it is in Canada but even if your were high and drunk, that still does not give him the right to kick ass because hes board and wants to fight. If the judge makes you get a drug test and they actully think that. it is valid then they are fuked; idiots will be idiots but cops that back up idiots should be held and tried for treason, in this country any way, I dont know what the constitution or whatever of Canda is

I would press charges. Just because someone is doing something you donâ??t like doesnâ??t give you the right to take matters in your own hands. This guy could have severely caused long time health damage and a lesson needs to be learned.
Take him to court, I would.
Itâ??s your messed up face (no offense) vs. his story.
