I've been thinking about growing marijuana for couple of months now. been doing all the research and the reading in the mean time. this is a great website and it always has the answers to all my questions but before i start growing i want to know all the drug laws. i know no one wants to talk about getting caught and dealing with the police but still its always good to know all the proper laws

I did some research on my own and came up with a little something:

Penalties for Growing Marijuana
At the time of introduction of the Marijuana Reform Bill in 2004, production of marijuana in Canada was punishable by up to seven years imprisonment. The Marijuana Reform Bill creates different offences depending on the size of the marijuana growing operation.

The penalties for growing marijuana under the Marijuana Reform Bill would be

for growing one to three plants, a fine of up to $5000 and/or 12 months in jail

for growing four to 25 plants, a fine of up to $25,000 and/or 18 months in jail, or if pursued by indictment, five years less a day imprisonment

for growing 26 to 50 plants, a sentence of up to ten years

for growing more than 50 plants, the sentence could be up to 14 years.

I wanna hear from people here on cannabis about canadian laws on marijuana production. is it a good idea to see a drug lawyer to educate myself more on this subject??

Personally i dont have any criminal record so i'm sure i will get a "soft" punishment if i get caught. I dont mind paying fines or whatever but its just the thought of doing jail time that gets to me

I wanna know what i can do or how many plants can i have at one time so even if i do get caught, i will not be looking at any jail time.

It would be nice if you can share your personal experiences on this subject or anything that would help me. i know some people here are extremely knowledgeable when it comes to marijuana. hey people your help is needed right now :):):)

Well, the 2004 facts are outdated..actually, Harper is introducing tougher mandatory minimum sentences for drug production offences.

He is unveiling tougher sentences for growing, however bunching them together with a bunch of laws about gang offences and drive by shootings...puts the important stuff in with a bullshit increase in growing penalties. But that's his game I guess.

I read somewhere the category is something like 1-300 plants gets you a year. 300-500 is 2 years and over 500 is anything up to 14 years.

But we'll see for sure when the laws are unveiled in the coming weeks. Supposed to happen in BC.

And its also useful to note the revival of the drug war under Stephen Harper. The senate said legalize in 2003; the liberals initiated decriminalization in the same year or shortly after...then we got stuck with the new drug war from the cons.

The proposed legislation would impose six months for growing one to 200 marijuana plants to sell, and two years for big-time growers of 500 plants or more.

There also would be a one-year mandatory jail sentence for marijuana dealing when itâ??s linked to organized crime or a weapon is involved.

The sentence would be increased to two years for dealing drugs such as cocaine, heroin or methamphetamines to young people, or for pushing drugs near a school or other places frequented by youths.

The bill also revives a failed initiative from the previous Liberal government to increase maximum imprisonment for growers to 14 years, from the current seven, for running grow operations.


6 months mandatory for 1-200 plants. not a good news for all the weed growers in canada

The key point of this bill is that it is tied to the selling of plants. Penalizing those who grow for personal consumption would only promote criminal related procurement.
