Caught with weed while pregnant by random search of sister on probation's room?

I just moved back home from my boyfriend's house. I just left all of my crap in my sister's room and left for about a week for Thanksgiving. While I was gone...My sister's probation officer came and searched her room. I am four months pregnant and no longer smoking but when I brought over all of my belongings that included about two ounces of weed and my vaporizor. Needless to say, they searched the room and found it all. My mom told them that it was mine. Oh yeah. Did I mention that I am on probation, too? Yeah. It's informal misdemeanor probation. I've been on it for over a year and it's non drug-related. Anyways. I wasn't even here when all of this happened. They confenscated it all and told my mom that they were going to contact my probation officer. What should I do? I am pregnant and don't even smoke weed anymore...I can't go to jail over this. Oh yeah. I also forgot to mention that some of it was trimmed and some of it was untrimmed so it was in like two or three different jars. They told my mom it looks like I am trying to sell. This is complete bullshit. It is in different jars because some of it is different and untrimmed vs. trimmed. I seriously need some legal advice. FAST.

WTF! Your Mom should NOT have made ANY statement to the police or probation officer.
DO NOT make any statements!
Get a lawyer. If you are no longer smoking, make sure you get a UA done soon and formally to submit in case that comes up as an issue. Your attorney will advise you on that.

They didn't find it in your house/apartment ...it wasnt in your possesion.

If you admit they will not aquit........anytime someone gets busted with weed and its seperated into individual baggies or containers and not in 1 bag .....automatic possesion with intent.......Its better to get busted with a LB in 1 bag.....you get busted for selling if its divided

The problem here is you werent in the presence of the P.O. at the house at the time the weed was taken..... make them prove it was yours.

If a friend or relative leaves 2 oz at your home and takes off...cops come and search your house ....you will be held responsible...not the friend or relative

Now on the flipside do you want your sister or mom to get slammed for your carelessness

Daaamn real sorry to hear that. I gotta ask..Why didn't you find some place to hide it long ago especially after being on probation? Far easier to find a safe place for it than to deal with get'n caught with it(simple as putting it in a mayo jar/whatever has a plastic lid that wont rust and bury it in the yard under a flat rock or covered next to a bush) A simple rule I live by that I call "The Shit List". "Don't mess around with shit and you won't get shit on you"...meaning "Don't say shit..Don't piss in shit..Don't blow in shit..Don't walk a strait line on shit, and don't listen to shit Johnny has to say.So..If you don't give 'em shit, counsel is worth a shit, chances are good in the end they won't have shit on you. Always gladly take 'em up on the "all expenses paid wkend lodging" offer courtesy of the county and let counsel fig it out. So.. Your mom may have made things rougher but you may still be ok. Also...I don't know if it makes a difference that she's a minor. She's only 15. Would it be better for her to just take the blame because she can get her record sealed when she turns 18?

the courts might go easier on her ....whats she on probation for??

Normally if you have a probation violation as a juvinile.....your probation is extended......or she may be required to do a drug class

I'm not trying to throw her under the fucking bus. We're trying to figure out the best way to handle the situation. She offered to take the blame because I'm pregnant and can't go to jail. I think she's already on probation for possesion, but I'm not sure exactly what it was for.
It was originally out in the guest house that was always locked and no one could search. I moved it because we had relatives staying out there for while so I had to move it. I didn't plan on being gone so long but I ran into some problems and I came back home literally 10 minutes after they were there.

You moved out of your house for a week? This whole situation coupd have been avoided. (The former heroin addict doesn't leave heroin just laying around his house) I still don't understand why you still had it.

i assume you were not charged. That would be a very tough case to prove...drugs in your sister's room and they charge you for them. Going anywhere with it the prosecution would have to call your mom. PS in these circumstances, if you are clean, you should immediately get a test to prove it. It can help quite a bit for your lawyer to show that you're not using.
