NM woman faces eviction over medical marijuana use

SILVER CITY, N.M. â?? A woman was told to move out of her apartment when the landlord discovered she has marijuana for medical use.

Bobbie Wooten, 47, uses a wheelchair because she was paralyzed from the waist down in a car crash several years ago and suffers severe spasms. She joined the state's medical marijuana program when it went into effect last year.

A management representative for Silver Cliffs apartments did a surprise inspection Tuesday and spotted two marijuana plants she has for medical use under a state license, Wooten said. She said the representative returned a short time later with a notice that she had three days to move.

A spokesman for the Arizona realty company that manages the Silver City complex told the Las Cruces Sun-News that the eviction is within the terms of the lease.

"My lease provides for a drug-free environment," said David Kotin of Kay-Kay Realty. "Obviously, she is in violation of my lease."

Wooten, who has lived in the complex for 6 1/2 years, said Thursday that managers have since asked for a copy of her state license for the marijuana. She said she hasn't looked for another place yet.

"There aren't that many places that are wheelchair accessible," said Wooten.

State Health Department spokeswoman Deborah Busemeyer said patients in the medican marijuana program can possess up to four mature plants, 12 seedlings and up to six ounces â?? enough marijuana for a three-month supply.

"We have never had a case like this where someone was told to move out," Busemeyer said.

The state law that took effect in July 2007 allows patients to be licensed to take marijuana for pain or other symptoms of specified debilitating illnesses such as cancer, multiple sclerosis and spasms associated with spinal cord injury.







This is SO WRONG!


Anyone in the Silver City NM area? It might be considered an act of compassion (or a public service) to find and post Kay-Kay Realty's contact info. I couldn't find anything on the web on them.

Everyone, if someone does post it, be polite, but express your displeasure about the decision. Even though extreme profanity, in some ways, totally appropriate in this situation, skip the cuss words! OK? Remember, there is more than one way to describe a cretinous low-life with no more compassion than an amoeba!

and this is absolutely crazy... I wish, they change their mind, so far they have asked for her license and that may be a good sign.

yet, if they found a cabinet full of pharma. DRUGS none of this would have happened! I just cant believe that someone would look her in the eyes and tell her this. Oh right, they would just send a letter. cowards!

well i think she is perfectly within the Law of NM's MMj laws and the realty manager has opened up the realty company too a lawsuit! if she has all her paper work she is in compliance with the apt lease agreement,and those are not street drugs they are infact prescribed medicine,so that manager needs to evict everyone that has a prescription for any kind of drug good luck with that buddy,oh yea whoops I think he stepped in it on this one lol. people take their personell beliefs into their work and try too enforce that on other people thats where big lawsuits come from, she needs too sue the pants off that company and she just might end up owning that apt complex serves them rite. go get them girl :thumbsup:

Thats discrimination! With her medical license its no different than a prescription for vicodin. i hope see gets a lawyer and screws the bastards!

Im preaty sure they threw her out and she is living eles where, all this, she could do this, and that, and lawsuit. Uusaly that doesnt happen here, if you get out alive most people move on, in her case I think she has done just that. law suits haha, not in The Land Of Entrapment. Poor lady will end up missing or worse, however I dont think it will be a ride in the park for the house owner (renter) either.

I had someone screw me worse than this last year. Just to think about suing costs thousands of dollars. unless its a personal injury case more than likely they wont take the case on contingency. so unless she got the ACLU or a disability union or something I doubt she could afford to take on this company. sad but true.... thats why I support vigilante justice! take it to the streets. :hippy:

From what I understand, SEVERAL lawyers have contacted her about taking her case. And the ACLU has an eye on it, too! :thumbsup: She is going to be on a talk show in Oregon and has reporters calling her. :D

I hope she sues the heck out of her former landlords! If they are smart, they will make her a very generous offer and pray she takes it! If not, some lawyer is going to chalk up a few rep points on this one!

good for her! You would think there is something in the Americans with Disabilities Act that covers her. How long you think he could have waited and just not renewed the lease? couple months to just leave the lady alone?
