A paraplegic man is suing Eddy County Sheriff's deputies for seizing marijuana plants and equipment to grow marijuana, which he uses to control pain resulting from a spinal cord injury. Leonard French received a license to cultivate and use small quantities of marijuana for medicinal purposes from the state of New Mexico under the Lynn and Erin Compassionate Use Act. The American Civil Liberties Union of New Mexico, which represents French, says the deputies' actions violated not only that law, but also state forfeiture laws and a constitutional prohibition on unreasonable searches and seizures.

SANTA BARBARA, CA - The American Civil Liberties Union applauded today??s ruling by a California Superior Court judge to uphold a voter-enacted initiative that directs police to focus resources on serious crime by making marijuana use the lowest law enforcement priority. Citing California??s ban on lawsuits that punish public participation in the political process, the court dismissed the city of Santa Barbara??s challenge of the law, known as Measure P, which was brought against Heather Poet because she was the proponent of the challenged initiative.

French v. County of Eddy, et al. - Affidavit of David Edmondson (02/14/2008)
An affidavit submitted by a local law enforcement official that states that the seizure of medical marijuana from a local paraplegic man, ??was done at the direction of and under the guidance and control of the [Drug Enforcement Administration] DEA.? The affidavit, submitted by David Edmondson, Commander of the Pecos Valley Drug Task Force, which conducted the seizure on September 4, 2007, makes clear that the federal government directed local law enforcement to seize the medical marijuana of a patient fully authorized to use the medicine under state law.

that day will not come in peace... it will only be gained by blood and flesh. my understanding of the situation is changing slowly...:wtf:

the people will never prevail through this kind of so called representatives that they have. there are few acceptable/good people out there but prevailing requires a good majority of them.

and given the nature of the people around here, i dont think that day will ever come, but money may force the govt on mj issue in a while... user stats are on the rise and they just cant keep up with arresting booking and trying everyone... soon their god (money) will force them to find a more efficient solution to their expensive approach, they will probably make it a ticketable offense,but still it will remain a violation

i donno, I'm just in a really pessimistic mood this morning for some reason. i predict an anxiety attack sometime this week, got way too much to handle for the next 2 weeks and i already feel overwhelmed. i might take a break from internet forums and news completely. cant stand extra mental pressure.
