View Full Version : Drug testing is illegal in Ontario.

Not too sure if there are many members on here from Ontario, I just want to let all residents know that drug testing in Ontario is illegal. If you are ever asked to take a drug test before being employed you can take legal action as this is a form of pre-screening employees. Once employed your employer can not force you to submit anything (hair, urine, blood) for any reason. If you are disaplined for not submiting a sample you can take legal action. If you are protected buy a labour or trade union chances are your union will protect your charter rights.

Would u please provide some source cited for this claim if at all possible?
Cuz I may be moving north in the future and am gathering general information regarding mj related issues such as this one...
if u can please post a reply with source, though ill be searching the internet to find it myself as well... thnx for sharing :)

I dont have an internet source, just the information provided to me by my union local IBEW 1687. One of our brothers was removed from a job site because he refused to take a drug test. We sued and were awarded 80 000$. Drug testing isn't common in Ontario but it does exist. In other provinces such as Alberta drug testing is legal and common place.

and do u have to have a union backing u up to be able to sue on such instances? or can workers themselves file lawsuits that will most likely succeed.
I have no idea how unions might or might not affect this complaint process. if u know anything plz illuminate me on this one :D
