View Full Version : Beat 4 felonies and got the cop that arrested me fired!!!

This is a part of why I haven't posted much lately, but it worked out great in the end. I had been under investigation by the KBI (kansas's version of the FBI) for some time, but they had nothing to warrent a search. So I leave the small town I was living in and a highway patrol is following me. I know this because my radar detector is going of the whole time on ka band, the one they use. But they can't pull me over for no reason because their dash cam runs all the time, not just whe their lights are on. Believe me, I was driving like a grandma going to church. I turn off on a county road to another town, and that's out of their jurisdiction. So they get on their cell and report me as an anonomous tip of suspected DUI. I pull into a gas station for a cup of coffee, and when I come out the local PD has pulled in behind my car. She tells me I'm suspected of DUI and does a field sobriety test, which I passed. Then she wants to run my licence. Valid. Then she want to search my car, no prob, everything is in my pockets. The search takes forever because my car looks like a pawn shop. Nothing illegal. Then she runs my name for warrants. I have none, but they must have tld her to find a reason to arrest me because she decides at this point to arrest me for DUI. They search me and find a quarter of herb and 57 morphine tablets, as well as some klonopin they for some reason didn't charge me with, and a knife they said was illegal. Funny part about that is she had a civilian ride-along who happened to me a marine corp major, and for a minute he forgot what what he was doing because he was like "wow, that's cold steel isn't it?" Anyway they charged me with-

possesion of marijuana with intent to sell?!?!
possesion of opiate with intent to sell
felony possesion of drug parphenialia
felony DUI
possesion of a concealed weapon (misdemeanor)

I have major priors, I'm fucked right? Except they had no reason to search me. So she said in her report she smelled the odor of marijuana when she approached me and arrested me for DUI. So before prelim I have my attorney supeona the dispatch logs. When I get to court they don't have them and she said "we don't keep those". So my lawyer is like "No, montgomery county sheriffs office has them, that's who you were calling" And you could see in her eyes she was scared as hell. She comitted perjury on a sworn statement and the logs would show it, there was a 27 minute gap between the first call to dispatch and when I was arrested. So they continue the prelim and next time she isn't there. Or the next. The third time they dismissed all charges. The bitch was deputy chief of police for cherryvale kansas and she got fired for not going to court. They seized my car, but never actually filed the paperwork so after 90 days the impound yard sold my car as abandoned, and it had my laptop and a ton of other cool shit in it. I could sue of course, but I beat for felonies and got the cop that arrested me fired, I guess I can live with that:thumbsup: My advise to everyone-Admit nothing, don't waive prelim, and don't settle for a court appointed attorney.

BTW I don't know why those links are in my post, I didn't put them there, fuck I wouldn't know how. And yeah I know I'm not supposed to mention drgs other than weed, but they were part of the charges so I'm hoping no one trips.

And don't order from the k-pin link that pops up, it could be a scam for all I know and the prices are insane anyway.

Good for you, and good for you knowing your rights, and good for you having a sharp attorney!
I myself am familiar with law enforcement there, not the KBI, the I-70 I-35 Drug Task Force, I have a file with them that they will likely have forever. Mind you, never arrested once in my life, nor charged ever, for anything. Many LEO's assume the people they fuck with won't know their rights, and think they can get away with some really stupid shit. I just wish your story (and mine) were the norm, and not the exception. Sites such as this with members, such as us, hopefully will change that everywhere!

Great, knowing your rights. Getting the right lawyer and sticking with it, until it served no purpose. No need to overdo things with car and stuff, you are right, you go rooked and let it go before there was a vengance cop around! Got out while the getting was good! Hard to know the difference! You have great insite or good advisor!! :thumbsup: PR :jointsmile:Think they were out to get me even before this happened (and not without reason), but I guess that's what they pay them for. And even more so now. I see people illegally searched on cops and similar shows all the time, and I wonder if they realize it. I've been keeping a low profile ever since, but I don't trip about discussing this with people, the charges were dismissed with predjudice. But they're just waiting to catch me slipping, I've no dought of that. Maybe this will give hope to those who are looking at charges, many cases can be beaten, but you have to understand your rights. And unless you go to law school you'll have to learn for yourself, they damn sure won't tell you. A couple other points when you get pulled over are that the shit belongs on you, not hidden in the car. They have much less right to search you than to search your car. And if you don't have a licence or insurance stay home or find a driver. Five days after this happened they did the same thing to a friend of mine whom they wanted as badly as me (well, almost). Her charges stuck because she had a suspended licence. Keep smoking, but don't be the dumb druggy they think you are.

What a great change of pace to hear a story where the system actually worked. Of course it's a little like AA you have to work it for it to work ;) And you certainly did work it. Good for you. Now your story can inspire others to work it for them. Great job!:thumbsup:
