View Full Version : Driving while carrying (searches?)

I don't like driving while holding but sometimes it's necessary and I had a few questions about it. I got busted a few months ago for possession and paraphenalia, where I live 1st possession is just a ticketable non-traffic offense so not that big of a deal.
If a cop were to pull me over, can he pull up my record and see that I have a previous marijuana offense and use that as some kind of reasonable suspicion / probable cause to search my car? Also, if I do get pulled over while carrying should I just give them permission and have it well concealed or deny a search? I figure if they ask to search I'll just say something like "I'm sorry but I have to be somewhere, can you make it fast?", hopefully they would just do a minor search and let me be on my way. I won't be smoking in my car so it won't smell, my car is all clean and all my lights work, etc. Plus I drive well to avoid any reason to get pulled over for a traffic violation.

well if your car doesnt smell like weed and there are no hints of it. i.e. a roach or blunt wraps in plain sight, then they cannot search your car without a warrant but that doesnt mean they wont try. Cops are dicks so they might TRY to search your car cuz of your previous record but they CANNOT. They need probably cause to search or else they need a warrant. Police are trained to intimidate and ask hard questions but you do not have to consent to a search!

If you don't let them search they'll just call for a K9 unit. Then they'll have the dog do a false hit on the car and you're screwed any way. Its kind of a catch22 deal. Screwed if you do screwed if you don't. When I'm in the car carrying I put my joints in a cleaned out highliter pens. If I'm getting pulled over its easy to just push then pens out my 4wd boot. Then I'm not in possession. Have never had to do it yet but its best to be prepared.

If you deny a search, it's not 100% they are going to call a k-9 unit. It all depends...but if you consent and you know it's going to get found, that is just plain stupid. Even in the event you deny a search and they call a k-9 unit, a lawyer has much more to work with than if you consented to the search.
Are you sure those highlighters are foolproof killerweed? How are you going to get them out of site? Have you seen such a thing work before? i'm intrigued, heh.
I was the passenger when we got stopped maybe 2 or 3 years ago. Nothing was in plain view, and no smoking occurred in the car, but we got pulled over for speeding by a state trooper, everyone including the driver stoned. Don't get stressed and do what the officer tells you. He gave the driver a ticket, asked where we were headed...we were on a road trip...asked if he could have a look around the car, kinda sly huh? the driver said no sir, and he said, you gentlemen drive safely, that was that. I mean this was the state trooper with the crazy ass hat and huge sun glasses, just be confident, but obedient...heheh

I try not to carry with me too,But when I do,I usually keep it in my trunk and it aint more than like a joint or a bowl or two's worth.

Keep it simple... put any weed and/or paraphinalia in the trunk for whatever transit. I am assuming from dealer to your home *ONLY*. Keep your vehicle clean, serviced, and in good repair. Keep the registration and insurance up to date, and *ALWAYS* wear your seat belt. Don't be out running around at 2am...keep your transit time during normal hours.. like from around 7am and be off the road by around 9pm. Drive normally, don't hot rod around, but OTOH don't drive exactly the speed limit, just go with the flow of traffic.
IOW....don't draw attention to yourself and put yourself in a position where somebody has to *DO* something about it. Above all, NEVER DRIVE WHILE UNDER THE INFLUENCE!!

I was driving through Texas about 5 years ago with a friend; my friend in his car, and me in mine. We were on the interstate, he was in front of me, and he got pulled over for speeding. So I just pulled over too so I could wait.
State troopers did a quick search of his car, which they said was standard procedure for EVERY stop they have to make. It was just like looking inside the car, and a quick look in the trunk, nothing had to be taken out or searched through. He had nothing illegal and was nice to them, so they let him off with a warning. I'd reckon they have that law so they can always check the trunks for people-smuggling, and running huge amounts of drugs across borders.
I haven't checked up on that to know if what they were saying was the truth or not, but yeah don't ever trust a cop. They only pretend to be your friend so that you'll waive your rights and give away your best kept secrets...
So, check up on the laws for city/county/state traffic stop procedures. Ya never know when they've taken a little bit more of your freedom away.
Other than that, just simply say "I do not consent to a search." Say nothing more about it. Short simple answers are best.

My advice is consent to a search while hiding your stash well, never on the outside, but in the middle, high up. Deer urine on the tires or a cat in the car helps throw off the prey drive. By not consenting this can throw out a huge red flag 'we have a refusal' now they know you have something and will try their hardest to find it. Maybe don't carry more then you can eat? Easier said than done, it depends on circumstances really.

Here is what we need to do, we round up a bunch of people that woulnt consent to searches that doesnt do anything wrong. These people will become the infamous time wasters to cops everywhere, cutting down on random searches!

listen ur best bet is to always hide ur shit on u, and i dont mean ur pockets if u know what i mean. fuck it. It sounds nasty but 10x out of 10 K-9 isnt in the immediate vacenity, and if they want to search ur car and log it in there memo books as reason for search was u were a suspect in a disturbance u have to hold that while they search. So just boof it, u aint getting a 3 point strip on the street. be complient, smile while they search, and flip them a :S4: as they leave with a :D of course, then go home and smoke ur shit. but on the other hand if its alot of shit do it in the day time. Cops are more reluctant to stop people and make scenes in the early hours of the day unless they really suspect u of something. Reason being cops are getting a rep. for harrasing civilians so they try to avoid being recorded on eveyones cell phones.

If you must transport your medicine by car, this is how to do it.
Two rules:
Never give probable cause.
Never give consent.
#1: DO NOT UNDER ANY CIRCUMSTANCES smoke or drink before you leave the dispensary or on your way home. Never ever. Never EVER ever. If the officer has ANY reason to suspect DUI, that is probable cause.
#2: Do not carry your meds or tools in the passenger compartment of the vehicle. Stow them in a locked trunk or cargo area that is not within the access of the driver.
#3: Do not give consent to a search. If you have not given probable cause by crossing marked lanes, driving erratically, having visible paraphenalia or roaches in the ashtray, having very red eyes plus a smell of weed, stinking booze, or speaking haltingly, you cannot be accused of OUI!
#4: Be POLITE and SPEAK CLEARLY. Politely ask, "Why are you asking that I consent to a search (or step out of the car if that is the case)?". Clearly state, "I'm sorry Officer, I cannot give you consent to search my person or vehicle". These conversations ARE recorded and will be accessible to your attorney if you do get arrested and charged. If the officer cannot give probable cause to have done the search in the first place, any evidence that he finds in your vehicle is suppressed before a jury hears it, and with no evidence, the DA can't do poop.
Learn your rights, and practice with a friend playing 'cop' just as you would practice for an interview. A traffic stop is an interview of sorts, but you don't actually HAVE to talk to the officer! Of course, you need to use your judgement to decide whether silence would make the situation worse. Generally, being able to talk to a police officer calmly and politely, as someone would who has nothing to hide, will help you de-fuse any potentially bad situations.
If we are talking about moving weight here, that's not the purpose of these forums and smuggling talk will be removed.
