three days ago, i was at my house with is in the middle of nowhere and the only people near me are related to me. I had an outdoor grow going on at my cabin which is just about a mile from my house. The cops show up at 9:00 in the morning and i was outside, then they call me over to his car and i get in the passenger seat and right then i saw my plants and i was screaming FUCKK!!!!! in my head. The cop said he know's i've been growin, cuz someone called them (it was my aunt that lives close to my cabin) Im only 18 and i live with my unlce, so he gave the cops permission to search the house and then they took all my pipes, weed, everything. i just bought a hookah 5 days before that and i had to fuckin give it to him. he searched everywhere too, I didn't have one scrap of weed left. I then spent the rest of the day at the courthouse gettin interogated. so now i have 2 misdeanors for simple possession and paraphenalia, and i have a felony for manufacturing. i was wondering if i can get the charges dropped due to and illegal seach and siezure because they went up to my cabin first without asking for permission to search and took my plants, the only problem is they were outside. btw this is my first offense for anything.

my ADVICE: don't ask us, or your friends, etc ... GET A LAWYER ... if your tooth hurt, would you ask a carpenter for help ? ... :smokin:

yea, im gonna call him tuesday, would do it tommorow but it's memorial day so i think there closed. i just wanted to know if a cop searches my property without prior consent, my permission, or a search warrent and finds a couple pots outside and arrests me for it, would that fall under "illegal search and seizure" and i was wondering if anyone has had any first hand experince with a similar sitiuation. I had 26 plants but the're only a month old and mabye 4"-5" tall, except for one which was really outdoing all the others it was over 1' tall. Image Reaper, i completly understand what your saying, im just trying to get as much information as i can, since i can't call my attorney till tuesday, i wanted to spend this time reasearching simillar sitiuations and learning all the possible outcomes. i've read alot already.

I understand ... in practice, the police generally charge you with everything they can think of ... then, your lawyer goes in and 'works the deal', throwing most of the charges out, in exchange for a guilty plea from you, to one or more charges ... that saves them time and money ... unless you're a real dangerous gangster, they really don't want to put you into an already over-crowded jail ... they want to get money FROM you, not spend money ON you ... it's an 'old boy' network, that almost always requires a shyster (sorry, I meant 'lawyer' ;)) to get you that plea-bargaining deal , however ... good luck :jointsmile:

If your uncle is legal owner of your house then they can get permission from him. Are you renting and can prove with rent receipts?

Your uncel gave them premission to search HIS house.. So no you aint got a case for an Illigal search..
Get your self a lawyer ASAP...

Sorry man, if your plants were in plain enough sight for your aunt to see them then the cop not only had the right to walk right up and rip them out of the ground, but he had the right to search the entire premises even without your uncle's permission. He also had the right to charge your uncle with everything that you were charged with, if he was allowing you to grow at on his property.

Once again... don't grow on your family's property without permission. And if the cops could prove that your uncle ALLOWED you to grow on his land, he could LOSE HIS HOUSE.
Go get an attorney... and smarten up. We do NOT allow talk of growing in the home of someone who is unaware of these activities... and if you get caught, well, it's on you alone to take responsibility for figuring out how to deal with it. Or get your family to help you, if they aren't pissed off at you for betraying their trust.
One thing to remember: Your friends may not always be there but your family will, so treat them right.
