Police acquitted over NY shooting

A judge in New York has acquitted three police officers who shot dead an unarmed man hours before his wedding.

Sean Bell, 23, who was black, was shot as he left a strip club in the suburb of Queens in November 2006.

Two detectives, Michael Oliver and Gescard Isnora, faced charges of manslaughter. A third, Marc Cooper, had been accused of reckless endangerment.

The case had generated accusations of police racism and brutality, and there were angry protests outside the court.

Mr Bell's fiancee, Nicole Paultre Bell, walked out of the packed courtroom as soon as Supreme Court Justice Arthur Cooperman cleared the three officers of all charges.

"The people have not proved beyond a reasonable doubt that each defendant was not justified" in firing, the judge said.

The defendants had opted to not be tried by a jury.



Mr Bell and two friends were apparently trying to drive away from the Kalua club when the shooting occurred early on the morning of 25 November 2006.

Mr Bell was killed and his friends both seriously injured.

Mr Isnora, who with his colleagues was investigating a prostitution ring, said he had followed the trio to their car because he believed they were going to carry out a drive-by shooting.

No gun was found in the car.

Critics argued the officers had used excessive force in firing 50 shots at the car.

A spokesman for a police union, Patrick J Lynch, told reporters that the verdict proved police officers could expect "fairness" in court.

New York Mayor Michael Bloomberg said in a statement that he accepted the authority of the court to decide the case.

"There are no winners in a trial like this. No verdict could ever end the grief that those who knew and loved Sean Bell suffer," he said.

The US Department of Justice said it was conducting a review of the shooting to decide whether a federal crime had been committed.

There was outrage at the verdict among Mr Bell's family and supporters.

Inside the courtroom, Mr Bell's mother sobbed and gasps were heard as the verdict was announced.

Outside there were shouts of "murderers" from among the dozens of protesters gathered.

Some wept on each other's shoulders, while others shouted "No justice in America!"

Veteran civil rights campaigners Al Sharpton and Jesse Jackson criticised the outcome, saying the case was about police accountability, not race.

Mr Jackson said the decision was a "travesty of justice".

Two of the acquitted officers were black.

Man how the hell can they get away with this? Its so wrong..:mad:

If a police officer was shot once they person would get the death penalty, but if 3 police officers shoot a UNARMED man 50 times, havin to reload the gun and continue shooting, they get away with it..

What is every ones elses thoughts on this?

I think the reason why they were aquitted with the charges is because the Judge not only gave them special treatment for being cops but also because he percieved it as an accident. I mean its clearly obvious that the cops didn't intentionally mean to harm an innocent person just to be a dick. More than likely it was a mistake on intelligence and that they probably thought they were going to do a drive by and assumed they had a bunch of weapons so inevidably it became a shoot first ask questions later. All in all it wasn't "cop's being evil" but rather "cops being careless". I personally would put this up there with accidental manslaughter. However, just because it was an accident it most certainly doesn't mean they should have gotten away with it just as Most citizens do not get away with accidental manslaughter. Also I don't think it has anything to do with race seeing as how two of the cops were black. All in all it was a shitty mistake which cost the life of an innocent man and therefore they should have paid for it with jail time, however, I strongly disagree with the notion that they were horribly corrupt and evil and blah blah blah.

If they suspect you have a weapon, dont they have to try stop you and search 1st even with guns drawn before thry can start shooting? There life has to be in danger before thry can pull the trigger..Right? Well there life wasent in any danger at all, and they didnt bother to try speakin to them 1st, They just thought "Fuck It, Lets kill some INOCENT PPL, cause we know we'll get away with it"..

Hope some day, these 3 pigs(cops) get whats commin to them...

You are totally ignorant of most of the facts in this case. If somebody tried to run YOU down, would you say that your life was not in danger?

They rammed the police van, there were fights, talk of guns, and they resisted arrest. The police over reacted, but under the circumstances it's not a crime.

This incident took place outside of a strip club in the wee hours of the morning, which was under investigation by police. This was not the best time nor place to give cops trouble.

Here is a newspaper report from Feb. 2006, shortly after the incident happened.



There are more questions than answers today as the police investigate an encounter three men had with the police in Queens early Saturday morning. The police ended up shooting at the men's car, killing a man on the day of his wedding and wounding his two friends. The men were not armed.


The three men, Sean Bell, Joseph Guzman, and Trent Benefield, had just left the Kalua Lounge, a strip club, for Bell's bachelor party. According to police sources, some undercover police officers were at the club to make prostitution arrests. The Daily News reports (http://nydailynews.com/front/story/474739p-399340c.html) that one of the officers overheard "a bouncer suggest to a dancer that he had a gun, and the cops went outside to warn plainclothes officers in a nearby van."
An hour later, a fight erupted outside the club. Bell, Joseph Guzman and Trent Benefield were allegedly among eight men yelling at another man, Kelly said.


One of the undercover cops heard Bell shout, "Let's f--- him up," and Guzman say, "Yo - go get my gun," Kelly said.


"It's getting hot on Liverpool, for real. I think there's a gun," an undercover warned his lieutenant, Kelly said.

Witnesses told of chaos, screams and a barrage of gunfire near Club Kalua at 143-08 94th Avenue in Jamaica about 4:15 a.m. after Mr. Bell and his friends walked out and got into their car. Mr. Bell drove the car half a block, turned a corner and struck a black unmarked police minivan bearing several plainclothes officers.


Mr. Bellâ??s car then backed up onto a sidewalk, hit a storefrontâ??s rolled-down protective gate and nearly struck an undercover officer before shooting forward and slamming into the police van again, the police said.


In response, five police officers fired at least 50 rounds at the menâ??s car, a silver Nissan Altima; the bullets ripped into other cars and slammed through an apartment window near the shooting scene on Liverpool Street near 94th Avenue.
Bell was shot in the neck and arm and died from his wounds. Guzman had 11 gunshot wounds and is critical condition while Benefield was shot 3 times and is in stable condition.

Kelly said the undercover officer who fired the first round identified himself as a police officer. However, Benefield says the cops did not identify themselves. Additionally, the police officers had anywhere from 5 to 17 years experience, according to Kelly. The police officer who fired 31 times had 12 years of experience.

HELL YEAH, I heard about that. THATS FUCKED UP. The police just lose their job if they kill people. Then some of them get away with it and go on with their job and its like nothing ever happened. FUCK THE POLICE!
