So I recieved this letter from the attorney general yesterday. Now first let me say,i've never made a overdraft in my life nor wrote any bad checks, and there is money in my acount. The letter siad "I owe $840 to xxx gas station or from 5 days from the 17th i'll be arrested."I recieved this letter Friday so I called. It was a bunch of b.s.

Me:"Yes my name is xxxxx xxxxx I recieved a letter claiming I owe the d.a.'s office $840,I don't understand all of my checks have been approved."

D.A.'s Office:"Well Mr.xxxxx, let me look on the computer."

D.A.'s Office:"The owner reported you for 5 bad checks totaling $385,the prosecing fee is so much and the d.a.'s fee is so much totaling $840."

Me:"Okay first off,i've never had a overdraft in my life and if these checks was bad,i'd have a overdraft or a bounce correct?"

D.A.'s:"Well you can go to jail, bail yourself out,and tell the judge(that'll cost me $1650)or you can come pay it!"

Me:(exact words)"i'll pay it and if this happends agian i'll sue and WIN,do you pepole think I am a idiot?!They never told me I had any bad checks, matter of fact, they owner loaned me $5 on night when my atm card broke,so someone is screwing me out of my f*in money and I don't apreciate it!!Let me guess I cannot speak to a D.A.?"

D.A.'S office:"If you do not have a attorney it will not be wise."

*Click*I hung up the phone

$840 in 5 days,for one,I believe that is unconstiutional,considering this is the first i've heard.Why don't we pull out of Iraq in 5 days?Yeah....that what I tought.

prob less of a Conspiractcy and more of a scam, where did you get the number to the da's office? from the letter? do gas stations accept checks? (no, not around here. :wtf:)

sounds like somone is trying to scare you into a hasty payment.

also: why dont you go to that gas station to inquire about this? and when they tell you its bullshit. bring it to the police.

ohh i could be wrong here but from my personal experience it looks to me as if you've been ganked/beat(victimized) by credit card fraud and/or(but not limited to) identity theft! Watch out for western union charges, those are the worst. Report the charges and file a claim of theft and you will probably not be held liable. Whoever got the gas made an amature mistake & probably also purchased and resold a good few cartons of cigarettes. Hopefully they signed it but even if its a friend of the true culprit it can be viewed as "just as good". good luck & report back.

Easy enough to beat.... take your bank statements and credit card statements down to the DA's office, along with there letter and *SHOW THEM* your accounts are correct, then offer to take it to the state attorney generals office, and the local TV stations news room if it can't be dealt with locally. You might also want to suggest that there is a possibility of identity theft by the gas station owner....I am assuming the ATM was at the gas station and not at your bank.
