So my friend and I leave our dealers house at about 2:30am. We had been smoking there all night and its a smaller tailor. So yeah we smelled like weed really bad. We were gonna goto the shell station and get something to drink and then goto his house. I have a new truck and my back tint is too dark to see it so I got pulled over. The cop immediately smelled the weed on us. He pulled me to side and patted me down and I was clean. As he's patting my friend down I start throwing up everywhere. I told the cop it was because I was really nervous(What else could I have said?). It was actually because I had been rolling with my girlfriend since like 3:00 pm. He finally asked if I had any weed in the car . I repeatedly told him no, but he wouldn't believe. He kept insisting that I tell him so he could give me a warning and not have to bring me in. I told there wasn't anything so he searched my truck. The only thing he found was an empty pack of phillie blunts. He then told us we could go.

Did the officer have to ask to search your car? Or did he just assume probable cause because he smelled the weed?

I would love to get pulled over stinking like weed but knowing I didn't have any in the car. I would deny the search all day long and make him waste his time getting dogs out there and all that. Then again, once they smell weed they may not need to ask for permission.

Also, in some states they can do a blood test with probably cause... in which case you would've been screwed I guess.

He also searched my friend but didn't find anything. Cruddy cop, the dude had two nuggets and a roach in his pocket.

He did ask me and I asked him if he probable cause. He told me he had it.

I also forgot to say he stopped me because he couldn't see my license plate through the dark tint.

Wow, this dude gives you weed and sews your clothes for you too??? LOL. :D

Isn't it a requirement or basically you agree to give consent at anytime in order to receive your license in most state now? Since driving is a privledge and not a right, you agree that you will consent to testing in order to receive your license and if you don't you are subject to suspension.

Remember probable cause doesn't equal warrantless search. You have to have probable cause and an exception to the warrant requirement to search the car without a warrant (plain view, consent, etc), search for possible weapons that would be in one's reach, or a inventory search if the car is towed following arrest.

Fix that dark tint and you will reduce yout chances of getting pulled over a whole lot. Anybody that is on the road at 2:30AM is going to be scrutenized anyway... did you just come out of a bar?? ARE YOU DRIVING UNDER THE INFLUENCE?? all they need at that time in the morning is an excuse to pull you over. *ANY* dark tint is an excuse, as is speeding or going too slow or...........
