So a wile back when i was still 17 i was arrested for underage drinking in NJ. when i was cought my boy was cought with an 1/8th of weed. We thought that we had gotten off because after a long time nothing came in the mail. Fast forward to last week when i get a letter in the mail telling me that i have to appear in front of a probation officer(NOT a judge) I was wondering can they drug test me? im most likely going to pass but there is a possibility that i may not ill have been clean for two weeks and some change. any help would be appriciated, BTW im pleading guilty to the drinking charge if that helps. You might get a copy of the judges original ruling in your case. If it doesn't say that you are to be drug tested they can't do it.If they try to do it ask for a copy of the judges order.

P.S.
It never pays to piss off a probation officer, so it might be good to be diplomatic about it.

I guess i wasnt too clear, i havnt gone to court yet, in Nj if you were a minor at the time of the violation, you first go in front of a probation officer. Thats all i know for sure.

One would think then .... that you have the options to decline a drug test. Since you haven't been found guilty of anything. Although once you deny a request for a drug test ... the judge might take that into consideration if/when it goes to court.

You'll have to check local laws ... a lawyer would be a nice resource.

I just can't see them being able to FORCE you to a drug test without first finding you guilty ... unless you settle "out of court". (which might be why you see a PO first *shrug*)

Thanks all for the info. Luckily it doesn't matter i just took a home test and after two weeks of abstaining i'm clean.

Idk man. I got caught back in september drinkin and drivin and i didn't go to court until 6 months after it happened and my PO said they will drug test me because alcohol is considered a drug i guess.

you'd think that even if you submitted to a drug test by a PO before your official ruling it would be disregarded because you wouldn't be officially on probation at that point and would technically not have violated.
