I got pulled over this mornin after a job interview. I had just finished a spliff and always spray fabreeze to cover the smell and a spray of calone works good also. the cop said he new i was high and wrote me a ticket for pos of weed. can i get that if i dont have any one me?? im confused on the ticket.

if the cop didn't find any and didn't give you a drug test then fight it.its like when your drunk and get a field sobriety test.you can fight somebodys opiniun {he looks high} but its hard to fight a test{chemical drug test}.

either fight it in court, or see your district attourney. He will probally get rid of the charge all together for you. And the reason is becuase he has to deal with all the tickets and crap, and he dont want to mess with the stupid shit like that.

But yeah, id say that cop is fucking with your 4th admendment rights there. lol.

for yourself..IF the cop didnt give you a drug test to determine if the chemical was in your body..there is no way a ticket can stand up in court..
remember the court has to PROVE you where high at the time you operated a vehichle..this will be very hard to do unless you were taken into custody, and had extensive testing done almost immediately....to be safe clean out and fight that ticket...most states punish for operating a motor vehichle while under the influence of drugs/narcotics just as if you were drunk....when is the last time you got stopped while drunk and then let go?

id probally be bad about that kinda thing too. I more of a person that doesnt like to.....speak out I guess you could say. But id see about consulting a lawyer ( if you can afford, lol) or someone in power to do somthing about that.

You said he pulled you over,did he have justification to do so?,if not then I don't care if you were rolling like cheech and chong in Nice Dreams,if it's not a legal stop,then it ain't a legal bust.I'd fight the ticket,don't want it on paper that sort of thing,next check by the LEO when they run your plates,and they'll stop you everytime,just to check you out.And the next time they might get lucky,and you're in a crap load of trouble.Good luck.

Problem with propable cause is that he can say whatever he feels like to justify the stop. He thought he seen somthing wrong or whatever. But yeah.

If the ticket is for possession then there are some clear legals steps that must be taken for it to stick.
#1 weed found and confiscated
#2 weighed in your presence
#3 you sign an agreement stating you witnesssed the weigh and agree it was yours.
without all that its not gonna stick and I question the cop even trying since he knows that. What country you in?

uhmm...........none of that shit happened to me......i didn't have to sign shit, it wasn't weighed in my presence....only shit was found and confinscated and i admitted it was mine to keep my bro and friend from taking the fall with me. but yea it stuck...and that shit is still fucking with me over a year later....

I know someone who was wrongfully searched and the cop found a QP of weed in his car. He had no warrant or just cause to search him so the guy took it to court with a lawyer and all charges were dropped.

If you can afford one get a lawyer. Even though you SHOULD be golden, a lawyer knows all the right things to say. Basically, if he didn't take anything, or administer a drug test, he has nothing to accuse you of. If you were driving poorly, then he would site you with reckless, if you were speeding, then speeding. If he saw you smoking than thats a different story. However (at least in my state) it needs to weigh I think a gram or more to be possession. Otherwise its paraphenalia. The burden of proof is on the state, but you have to plead innocent for him to PROVE that you did it. Best of luck to you.

I dont think they should be able to tell if your high from a drug test...I mean it only shows if you have indeed smoked marijuana, but it doesnt show the exact time.
