Ya, I got another possession charge the other day. It looks like I will be back on probation, and have to pay a bunch of money out. I'm sooo pissed!! These stupid cops bust me with a couple grams, and now I'm up to my eyeballs in stress. I still can't believe it's a crime to have a few buds. UUUGGGHHHH!!!

Sucks. Get caught with a few buds here and they just take it unless you get the "robocop".
But be lucky for probation, of buddy of mine is on his 2nd charge for posession and doing 9 months. (He had 2 lbs though)

Well I didn't have that much...luckly! However, I did talk to a lawer I found through the norml website and he said I will get probation, or maybe just fines.

Ok, I had about 2-3 grams in my pocket. I was out with my brother in law on our way to a pool hall, when he kinda goes through a traffic light as it was turning red (he had a few beers). We were pulled over, searched, and both arrested. He was arrested for DUI and taken in, while I was arrested for simple possession and given a sitation(sp).

I have to go in and get processed in a few days. Then just wait for the court date. The lawer I talked to said he usually works on federal cases, and would be pretty steep for my kind of case, so he recomended me to a friend of his that is sympothetic to cannabis laws, and costs around a third of what he charges. I am sopposed to call him in a few days for a consult. I am going to push for unsupervised probation and an appropiate fine.

In that situation, I'd consider myself lucky that I wasn't injured or killed in a DUI-related acccident.

Good luck in court.

<sigh> You wouldn't have a problem if you didn't put yourself in a position where somebody has to *do* something about it.

If you had left the weed at home, you wouldn't have a problem.

If you hadn't been riding with your brother-in-law *knowing* that he had several beers, you wouldn't have a problem.

You didn't learn the first time so its costing you a shitload more $$$$, and heartburn.

2 simple things to keep from having problems...... Keep the weed out of, and away from *ANY* motor vehicles, and 2nd, Keep the weed in the privacy of *YOUR* own home. Its not always your fault.... but you never know what the idiots around you are gonna do that will put you at risk.

Dude,

If your buddy got pulled over for DUI then why did they search you? Did you let them? If so it is your fault you got busted. If they asked you can we search you and you said yes, you gave up your rights. If not and they searched you anyway then that search was illeagel. They have to have a reason to search you. Just because your brother inlaw was driving drunk is not a reason to search you, you were not breaking the law. The only leagal reason I can see for them too search you is if they smelled it, then they have the right.

I am not a lawer but I know my rights.

There are a lot of should have would have, but in the end I made a few bad decisions. I.m not saying I am not in any way to blame, but I just wish a little bud in my pocket would not be a crime.

Well, here in TN all cops have the right to give ANY person a "terri" search, or search for weapons for the officer's safty. I had the bud in a jar, and according to the lawer I talked to if they feel a medium to large, solid object in a pocket they can make sure it is not a weapon by having you pull it out, or in my case pulling it out themselves after I assure them it's not a weapon. Never the less, the cop that pulled us over was a K9 unit, so if they wanted to bust me they would have anyway. I know my rights, but police have getting around them down to a science. They have bi-laws for just about every right you have.

Ok, I went to court yesterday and all charges were dropped. Since I never gave the cop permission to search my pocket, and didn't give up what I had, the search was unjust. Also I came to court with a clean drug screen, cert. of completing drug school, pay stub, and college transcript to show I was a responsible person. The prosecutor dropped the case before I even went up before the judge.

I am so relieved! I will defiantly not be riding around with anything again.

Peace

Take the lesson and remember it and then at least you gained something from the whole experience.

Lucky? Yes, but I also put the ball in my court by not granting permission to search me, not telling the officer what I had, and bringing plenty of evidence I was responsible, not a drug abuser, and proactive to get the situation resolved.
