Okay, I had to talk about this now because I am stressed and freaked out right now, but earlier tonight at about 1am, bullets came through my wall. My fiancee and I were asleep, and heard the gunshots, turned on the light, and saw bullet holes in our wall.
We live in a duplex apt, with our daughter, and after determining everyone was okay, I called the police. They have been in and out of my house since about 1:30am, taking pictures and gathering evidence. They found additional holes in my daughters room, AND A BULLET LODGED IN HER MATTRESS. I am just so stressed out now. And you know what I want to do....but can't right now, until they all leave.
I called my realtors and left a message on the voice mail regarding the situation, but let them know that either the people next door have to move, or they are going to have to let us out of the lease, because I can't live somewhere I have to dodge bullets. This is byfar, the craziest, strangest thing to happen to me in a while, like something you see on the news, but never happens to you kind of thing.
Any other suggestions, or things I should do that I have missed, let me know, my mind is not operating on it highest level right now.

well do you think it was intended for you or that they wil for some other reason be back? if so go to a motel/hotel and find a new place by like tomorrow or the next day or something...

if the police are there, someone next door should be going to jail for negligence with something to do with possible harming a child. if bullets not a bullet came thru the wall, then the police will for sure be taking someone away tonite. 1 bullet accident 2-75 not so much an accident.

No, the bullets were not intended for anyone here...it is a young couple next door, and they have only lived there about 2 months, and argue frequently. I don't know if it is a domestic abuse situation, they are quite loud sometimes, and I have heard the girl crying....
They took the dude to jail for tonight, and all the guns out of the house, they way they talked, there were several.
I'm just wondering if the realty company can kick them out legally without notice since they have broken the lease by doing illegal activities in the house? I know I don't want to stay here another 30 days if that is the case. It's bad enough I have to have the police even over here, going all through my house taking pictures.
I just feel like if he did it once, he would do it again, and the police said he can probably get his guns back in a few days.
And trying to explain what happened to my 8 year old, who had to get up so they could recover evidence from her room, why there is a bullet in her mattress.
I need a Xanax in addition to my other "medication".

I'm sure your neighbors will not be there for long. They will either get kicked out or ol girl will DEFINATELY better get a restraining order.

I rent to people. Standard lease agreements specify no illegal activities. Illegal activities are grounds for immediate eviction, But I can't tell you weather it will take them 1 Day or 30. That depends on your state "tenant & landlord rights". Some states favor landlord while others favor tenant.
You are within your rights to cancel the lease. But step one is to make it clear that its them or you. Your a good tenant that doesn't have to put up with this crap, These tenants next door sound like a landlords plague. If your realty company has any brains they will work 100% on your side with-out revealing that your behind the complaint.

dude definitely dont endanger you/your family's lives. lodged into the mattress of my daughter? heh im only 19 but if that were the case for me we'd prolly be sleeping in some hotel until you can find a new place. take care man.. hope the toking relieved some stress

I'd move away instantly. If that guy goes to jail, he might want revenge when he's out. I wouldn't want him knowing where I live.

If my childs mattress had a bullet in it ,my neighbor would have a foot in their arse!

thats scarry man I know how you feel. I live in a condo and my neighbor has an SKS assault rifle and I was visiting him one day and he showed me how he keeps it loaded and twirls it around in his hands like a batton I wasn't sure if the saftey was on. Also if he does shoot anywhere near his door the bullets are going to end up in my room.

That kind of thing used to happen to me all the time. If you know the bullets weren't meant for you, you don't really need to move. But it'd still be a good idea anyway, since you have a daughter and stuff...

So sorry about this, Ceecee. Hell yes, the landlord should kick the shooter the heck out, and if he/she doesn't, you need to get a copy of that police report once it's done and write a very firmly worded letter accompanying a photocopy of it assuring your landlord that you'll engage the services of an attorney to get out of your lease if you need to to protect the safety of your fiancée and child (a threat here should suffice; you won't really need to hire a lawyer unless you have the most disreputable landlord in the world). Most standard lease contracts have clauses about illegal activity and sections empowering the landlord to terminate the lease, with illegal cause, at will or possibly with a defined notice period. If you can find the lease you signed and find that clause in your paperwork, you'll know it exists. That's not only for the protection of the landlord but also the protection of good tenants like you and your family.
Don't count on Mr. Bang Bang Domestic Violence being outta there or kept at a future distance defined by a restraining order. I've volunteered for nearly 20 years in a crisis center that deals with domestic abuse, and if there's one thing a large percentage of those ladies do, it's take abusive losers back into their lives with alarming speed, particularly if they're scared not to. You might consider finding out the address and location of the nearest women's shelter in your area and providing that to your neighbor anonymously. Also, if you live in a medium to large city, your police department will have someone on staff with a title like "victim's advocate," who is basically an officer or social worker who can assist the young lady who's your neighbor and help her access the protective services she needs. She didn't break the law, so there's no solid justification to evict her from the property next door. This is not good news because, of course, if he's got her in his targets, as long as she's still there, others around that apartment are still vulnerable to any more offenses he may commit.
I hope to heck he has a long criminal record and is being held someplace without bail, but that's unlikely. Chances are far greater that he has a long record as a domestic abuser and has never once been charged or held accountable for anything. That's the way that works in most of those situations. Best of luck, Ceecee. I hope you can soon feel safe again in your home--or can get to a safer one as soon as possible!

Here's my update for any1 who may be interested...
The realty company has given a 48-hour notice to vacate to my neighbors. They said if they do not follow it, then they will have to go through the court, and it may be 30+ days.
I was wrong in my assumption that it was the male firing the gun--apparantly it was the female, who threatened suicide, but somehow missed herself 3 times and almost hit my family.
The male spoke to my father, when he was bringing my daughter home and expressed his apologies for the incident, but I have not yet been able to forgive, nor have I been able to sleep, so I went to the doctor today, and was given an Rx for Klonopin, and have been told I am having "anxiety".
I don't have much faith in pharmaceutical companies, so I am debating on whether or not to take the pills, but at this point I would do nearly anything to sleep for 8 hours. So it may be my only option.
Also, I found a "Gunshot Residue Evidence Collection Kit" envelope left in my home by the police, so I had to take that back to the police station today, and I now see how evidence is lost. I can guarantee if they left it at the neighbors house, they would have never seen it again.
I was able to get a copy of the police report and it stated that the male is 21 and the female is 18, and they were both arrested, and when the police initally arrived, they denied that anything had even happened! How stupid are these people to lie and say "they just woke up" when there are bullet holes in my wall? Then it came out the female fired the gun and was charged with shooting into an occupied dwelling (with chance of injury) and the male was charged with aiding and abetting a felon for hiding the guns for her.
Their court date is 12-10-07, and I plan to be there to see what happens.

Probably the female lying to protect her boyfriend. If he shot at her thats attempted murder. She tries to shoot herself and everyone looks the other way on it.
I hope there being held until court.

Hey mate I think don't quote me but I think you can go to a motel until a final decision has been made at their (the complex or association) own cost.An attorney that lives in my apt said thats possible as long as its not a safe environment. That also causes for a lease or any other contractual agreement to be null & void. Hell if they kick them out tomorrow you can still leave on the grounds of safety and the chronic fear of death due to the situation at hand.
P.S I know this is a tough time for you but there's always a silver lining and you being able to tell us this story with your entire family intact seems like quite the lining.

:jawdropper:That's fucking crazy!!! If I were living in an apartment and bullets came through my wall I'd freak the fuck out. Glad to hear everyone's ok... Rest easy that they're being kicked out so you wont have to deal with them anymore. Hopefully your new neighbors will be much better.
