Cops cant search your car without a reason or permision from you. So me and my bro were in my truck smoking and a undercover van zoooooomzzz up next to us and two guys ran out to the sides of the car, i droped the one-shotter under the mat on the floor, they didnt see it though. They ended up letting us go, But never searched my truck.....it was reaking of GANJA SCENT! can they not search the car if they smell it? or do they have to see it?:smokin:

They have to have a search warrant to search your vehicle. They can call a K9 unit in and if it hits on it then they have reasonable cause to call a judge and get a search warrant to search.

There is a way to play this game too. If they ask you if they can search your car say no. Always say no. They'll ask if you have anything to hide,just say its none of there business. He maybe an idiot and get real curious and say I'm going to search the car. If he does just repeat you said no and let him have at it,don't argue. If he finds anything he can't use it in a court because of no search warrant. So you got to just watch him fuck himself. Cops make lots of mistakes. Try and help them as much as you can.lol:thumbsup:

well it is proven if they have a bag of weed confiscated from your vehicle. The trick is if you gave consent to search or not... and the cops can easily lie about that unless there is a tape recording or something

edit: also do you think you will get your weed back if there was no consent given? just thinking about it...

You don't want to be too much of a dick to cops.. Remember that they're the law and they can do whatever the fuck they want.

If you don't give consent, they can find something to lie about and insist there was 'probable cause'. However, a good lawyer will win your case regardless of the circumstances. The goal is not to get fucked up by the cops.

Cops do NOT need a search warrant to search your vehicle! DO NOT believe that, because it's a false security blanket. Here's the deal.

1.) A cop can search your vehicle if they have sufficient cause. If they look through your window and see a bag, you're fucked. I don't think that smell is a sufficient reason, but I wouldn't take my chances on that.

2.) If a cop is dead-set on searching your vehicle, he can call and get a warrant and a K-9 unit.

3.) If you tell a cop that it's ok to search your car, they don't need a warrant or anything. Never tell them it's ok. Even if they threaten to get a warrant or call in a K-9 unit, you won't be in any more trouble if they do all of that, and there's a good chance that they're just bluffing. ALWAYS deny the consent to search. Even if you have nothing on you, don't allow them to search your vehicle because it will give you practice and experience in that situation.

4.) Avoid lying to them. While you're protected against self-incrimination by not being required to answer questions such as "do you have any drugs in your car?", that doesn't mean you can lie to the cop. If you can't be honest with them without incriminating yourself, then don't tell them anything. Use common sense when it comes to this, because you don't want to bring suspicion onto yourself by being silent, but you don't want to have an additional charge added if you're caught in a lie.

EDIT: Also, if a cop insists on searching your vehicle, tell them "no" but obviously don't physically stop them. If you can prove that your vehicle was searched illegally, then any evidence they have against you (ie. what they found in their search) can NOT be used against you in court, and your charges will most likely be dropped.

smell may not be probable cuase in SOME states. but some states a grateful dead sticker on your car IS probable cause. it all depends on where your at

A policeman can and will lie to get to you. Also, smell can give them probably cause, at least where I live.

I've actually had a policeman say that they smell marijuana and basically barge his way into my car. Good thing I had smoked that J and lost the roach long before I got pulled over. He looked like a fool.

The smell of marijuana IS enough to search a car without a warrant. Learn the law, stay out trouble
