Injured rescuer sues family

Richard Cosmillo holds his grandson, Joey Cosmillo, who is profoundly disabled after nearly drowning in the family pool. One of Joey's rescuers is suing the family over injuries she suffered.
CASSELBERRY, Fla. ?? A police officer who slipped and injured a knee during a rescue call has sued the family that phoned 911 after their 1-year-old boy nearly drowned.

The child, Joey Cosmillo, now almost 23 months old, fell into the family pool in January. He was resuscitated but suffered severe brain damage and can't walk, talk or swallow. He lives in a nursing home and eats and breathes through tubes.

Police Sgt. Andrea Eichhorn alleges the boy's family left a puddle of water on the floor, causing her fall during the rescue effort. She broke a knee and missed two months of work.

Eichhorn's attorney, David Heil, said she has persistent knee pain and will likely develop arthritis. He said city benefits paid by workers' compensation and some disability checks helped with medical bills, but it wasn't enough.

"It's a situation where the Cosmillos have caused these problems, brought them on themselves, then tried to play the victim," Heil said.

The lawsuit seeks unspecified damages.

"The loss we've suffered, and she's seeking money?" said Richard Cosmillo, 69, the boy's grandfather who lived in the home with his wife and the boy's mother. "Of course there's going to be water in the house. He was sopping wet when we brought him in."

Eichhorn's suit named Cosmillo; his wife, Maggie, and the boy's mother, Angela Cosmillo, accusing them of negligence. They were careless, according to the suit, and allowed the home they shared to become unsafe.

Eichhorn's personnel file includes numerous commendations. The 12-year veteran has worked as a hostage negotiator and prostitution decoy, and wrestled razors away from a suicidal person.

If any judge awards him money he needs to be removed from the court. It's not the families fault this officer doesn't know how to walk in wet areas, some times you just gotta realize you are a retard, that's why you fell! lol

And another thing. This cop is a lieing piece of shit.She has full medical coverage throught the police force plus she is automatically covered for an on the job injury by Washington Dept. of L & I. Another example of the fine upstanding citizens we have in the police force here in Seattle.

If the cop wins this will set a dangerous and rediculous precedent: civilians who call 911 will thereon be responsible for securing an area during a crisis situation, rather than call professionals who are qualified and responsible for responding to dangerous areas. Utterly rediculous.

People make me sick, I mean id sue the shit out of a rich person if i could, but suing a grandpa after his grandson nearly drowned and is permanently handicapped is just sick. That police officer deserves whatever bad karma she has coming her way...

The Casselberry police officer who was suing the family of a young boy who nearly drowned in a backyard pool has now dropped the legal action.

The case gained nationwide attention after Sgt. Andrea Eichhorn sued because she slipped on a puddle of water at the house while responding.

She claimed the family was negligent.

However, the lawsuit was dropped on Thursday.

Some legal experts said it never would have stood up in court.

"The answer is really simple,? said attorney Dan Newlin. ??The family is dealing with a horrific situation where a child who has brain injury as a result of an accident. To bring more stress on family is something we don't do. We help families."

Eichhorn was also placed on leave by the Casselberry Police Department.

The city's chief was against the lawsuit all along.

There have been hundreds of cases just like this, suing people seems to be a national pastime in the states and it's getting just as bad this side of the pond too.
If someone brings a frivolous lawsuit they should be prosecuted IMO.

well she could have been suing the family, as long as the insurance would pay for it, there shouldn't be a problem right? As long as the money isn't coming out of their pocket and they don't have to pay higher premiums, why not? fuck the system and the cops she rode on ;)

if the judge lets this go thats ridiculous..around the downriver here i know a few police officers and people who are "higher Up". i just read this and it reminded me of a judge from around who here who puts about every kid on probation for just about anything and puts them into work groups that they have to pay for and the whole catch is that he owns the work group they are sent into.
