Apparently Epic breached their contract with a few developers namely Silicon Knights by withholding proper coding and support for their Unreal 3 Engine until, meanwhile using the the full, working engine to make and release their own titles.

After much delay and problems with the broken Unreal code Silicon Knights was forced to abandon the Unreal Engine and create their own Silicon Knights Engine. This however has caused much delay with their game Too Human as well as other unnamed projects and lots of lost funding that was spent during that time. Silicon Knights seeks damages by seeking to receive earnings from the title Epic was using the full coding on Gears of War.

After Too Human is released Silicon Knights will remove any tidbits of U3 Code from their Silicon Knights Engine and all their future titles will use it.

...very low of you epic very low I'm highly tempted to boycott you.

now that's just fucked up... i hope SK gets a nice beefy settlement (which, juding by GoW's fame... they will :D)

Well if it did, other developers could always pay Silicon Knights for usage of the engine they built. :)

But yeah it's kinda sad as Epic makes good games, this is a low of them to do.
