those of you who know me might remember that I was raided a few months ago......well yesterday the doc called and said im approved for a card(legal to gro) Today I recieve a letter from the DA's office ...they have charged me w/manufacture and possession of a controled substance.here's the problem.....you cant get a license thru the state if you have a case pending.I also cant beat the case w/out the license. so the timing on the charges is absoultly terrible, and now I fear I may end up going to jail on the charges.

The first court date is arraignment, just a guilty or not guilty plea (gonna plea not guilty)and im out....What im hoping is that i'll have all of my paperwork together before I go to an actual hearing.will the paperwork that I currently have get me off the hook???? I dont know.

I recieved my papers from the doc today and will send them to the state tomorrow. as soon as I have the certified mail reciept (saying its sent) Im legal to grow..... should I fire my room back up?? or wait till after court is done??

I would definitely wait till the court case is over to not complicate things.
Definitely get a lawyer.
Oregon is a pretty liberal state if you get the right people on the jury this could go your way very easily.I doubt the judge will allow your med license in after the fact but if you have a good attorney he'll find a way to sneak something in.
All it takes is 1 person to not convict and your off.Make sure you discuss this with your attorney.

here goes in Denmark where i live if your sent to jail and cant for personal reasons or just dont wanna do the time, there is a way
(who would do time if they could pass)

you find some one that ows you loads of mony, a to kill for fawor or someone just wanna make some money and dont realy care how!

this is how it works
if you make bail or can go home from court, and have to do your jail time later
this someone will then be fitted with your social security card and has to show up of free will the day he/you should do the time.

if the socialsecurity card maches, they wont take your fingerprints or anything, they just figur it has to be you...if they dont have pictures of you that is
*it dosent work if the cops have to come get you/arest you couse then you will be procesed and they then do a full tjek on you, so make sure that the person that subs for you, knows everything needed the smallest bit of info missing could be a dissaster and end with they find out and get the real you and then its not just the charge you had befor but the lot.....
therfore he must know eerything so that he can pass as being you the intire time he is behind bars for you

as i said its prob harder or just not possible in the us but i can try to find out more if you want?

and no i would deff wait untill the court days are over it could get much worse on you in a case where they find more shit on you.

2. Maybe it would be a good idea to start growing, pretty much saying that you need this weed for your medical condition, and even though u were caught now it's legal for you and the charges aren't going to deter you. Dunno if thats a good idea or not, but it's a thought. Maybe if they asked you if u were growing and said no, they would say "then you obviously don't need it that badly."

ok I went to arraignment yesterday....plead not guilty. the maximum jail time for manufacture marijuana in oregon is....20 years!the max for possesion of more than an ounce......10 years!
so basically for my few small plants (thats all I had by the time they searched) Im lookin at a 30 year term in state penn.
of course I dont expect it to go that way but DAMN! thas alott.

this is my first time facing this particular charge. I havent seen my attourny yet (I will two days from now),he sent me a packet of the D.A.'s evidence and a copy of the "DEAL" they're gonna offer.as I said they charged me manu./poss. of over an ounce....both felonies.they offered to drop the manufacture if a plea guilty to possession of over an ounce.according to the lab report I was in possesion of exactly 14.8 grams (plants/weed total)so they will have to drop it to a misdemeaner possesion.when they drop the charge down to a misd. the D.A. might make a new "DEAL" arrangement,or they may let me plea to misd. possesion. I will know more on thursday and post the new info.

This is a possible scenario-
Very likely you can plead that the state has enough evidence to convict you on one of the charges (not a guilty plea, it gets entered as continued without finding) as part of a deal to drop the other. You would then be put on probation for a number of years after which time the charges would be dropped if you don't get in any more trouble.
I was recently arrested for a pair of felonies and got one charge dropped for agreeing that the evidence was enough for a conviction. This is REALLY common where I'm from (MA).
If you DO get in trouble or violate yor probation in any way, the downside is that you've waived your right to a trial and have to serve the time.

Sounds to me like you may want to approach them with an offer to plea no contest to a misdemeanor possesion, before they get any more passionate about your particulate case. Similar to what Stinky's saying. You could also propose 1-2 years probation with like 6 months suspended. Maybe you get lucky, couldnt hurt.

I went and saw my attorney I pointed out to him that the felony possesion was actually only a "violation" apparently possesion of less than an oz. is not even a misdemeanor here.....so he's talkin to the D.A. about a new plea bargain. I'll know more in a cpl days.

i once fucked up in the army and got in a huge fight with an supirior officer and to other with same rank as i, i faced a longtime jail sentence...but my attorney and i talked them into a deal where i just paid them a huge fine left the army and got to keep my civil job and no record was written in my papers of the insident
if it where in my criminal records i would have lost my civil job asswell. (security)

Actually....what this guy is talking about in Denmark (?) is simply a variation on the standard "take my test for me" and it's nothing new or even just in Denmark.
NOT that I am saying this is a good idea mind you....just not a new one.

OK so we have been unable to reach a plea agreement.therefor on monday I have what is called a change of plea hearing,which means just that you either plea guilty and take the deal or plea innocent and go to trial.the last offer the D.A. had was plea to somethin i didnt do (still a felony) ,altho it carries a slightly lesser sentence,I cant do it.so we go to court monday and set-up trial dates an stuff.
Im not a felon! I dont deserved to be one! If I am convicted on these charges,I will do everything I can, to screw the system in anyway I can!
A felony is something that never goes away.....once your a felon...you stay a felon.
That being sayed I figure if the state wants to create a felon, I will oblige them.I will commit many felony's against the state.

I helped a med. patient get his grow going......I walk in one day and I see that he hasnt waterd in over a week...(20 plants, 7 weeks into flower)...his only job was to water every other day...everthing else i handled for him.So I tell him .."If you cant even handle watering....then I cant help you" and true to my word...I quit helpin....2 weeks later he rats me out to the police.....too me the worst part is the fact that I basically handed him 20 mature plants, ready to harvest.....and he rats me out for it?!?!?!?!

So what happened? Why did they just drop the charges? I have faced criminal charges and usually its a long drawn out ordeal. My first case was almost 2 years. Usually the longer it goes, the better the deal they give you.

the main reason they had to drop the charges was "illegal search an seizure" the fact that i got my med card helped also. they ended up giving me back everything they took,except the actual plants which were dead anyway.
