Well yesterday, I was on the NORML website, looking at what laws each state has regarding marijuana, and I found out that a lot of states have the marijuana tax stamp law. Now, no one really does this, but I thought I'd tell everyone who doesn't know, because if you get busted, and live in a state with the law, you can get even more screwed over, and get more jail time for evading taxes.

Let me explain. The law requires you to put a stamp that says "Marijuana Tax Stamp" and your state name, on your bags of marijuana. Even though marijuana is illegal, you are legally required to tax stamp it.

Now, they did this only to screw people over. Most people aren't going to buy Marijuana Tax Stamps for fear of prosecution of possessing marijuana, since that is admitting you have some. So, if you buy these stamps, there's a great chance they will be aware that you possess cannabis. So, most people don't buy the stamps, most don't even know about it.

Now, since you are legally required to put these stamps on, you are legally required to file it on your taxes. Obviously doing so, is illegal, even though it's illegal not to.

So, if you get busted, and don't have your stamps on, the dumb ass prosecutor can say you were evading your taxes, and put you in jail for a long time, since that is an addition federal offense.

It's a lose-lose situation. And the sad thing is, is most people aren't even aware of this. Another loophole for the law the use to put innocent people behind bars.

You have to bring the weed to them in order to get the stamp. They arrest you when you bring it to them to the the tax stamp. There is no way to actually get one, I doubt they even make them. It is just one of those bullshit laws that we can do nothing about.

Nobody try and go and get one. I think my state has it.

What if you don't have a job though, therefor you don't have to file taxes? Would they still say you are evading your taxes?

Yea it still is. Damnn I'd love to get one from Florida and just hang it up. I think it's an interesting conversation piece. Anyway what website did you find all of this on?

Sorry about the double post but I just found out that TN was the last state to approve a tax stamp. That shit happened in 2005 so I guess it really is one of those charges that you dog pile upon a dealer.

That was actually what they did to technically criminalize cannabis to begin with. They would say, "You can only have cannabis if you have a 'Marijuana Tax Stamp'". The only problem is, they didn't make them.

Didn't the government do that in the 30's or 40's with machine guns? There was a big problem with Gangsters having illegal Tommy guns so they said if you want to make you gun legal to come in a get a stamp, and when people went to get the stamp they were busted.

In order to purchase the stamps from the state, you have to apply for an official illegal drug dealers license (which costs $100 by the way). (Click here to see a copy of my license.) The assumption of course is that anyone dealing in illegal drugs will not bother to purchase the license. Although the law requires that the name & address of anyone purchasing the license and the stamps be kept confidential, you do have to supply the state with your name, address, phone number, and social security number. (Click here to see the order form.) One doubts that a criminal would be willing to provide that information. Since the law was passed over ten years ago,only 18 people have purchased the license (all presumably stamp collectors and stamp dealers). This includes Flying Buffalo's license. (For the record, Flying Buffalo Inc does not deal in illegal substances or condone the use of same. However we have always been fascinated with revenue stamps of all kinds.) [See the PS below]
